ATF Raids Polymer 80

We need to stop kidding ourselves that we are a 'right' and 'just' country. We have a system of justice that was designed to be fair but in reality the application of justice today is as politically biased as at any point in our history. Feelings over facts. Pandering over integrity.

Earlier today TFB reported on a story in the Wall Street Journal stating that the ATF had apparently conducted a search warrant at Polymer80 Inc, a company known for producing 80% firearm kits and related parts. These 80% builds, often referred to as “Ghost Guns” by media outlets, presumably because they can be built into firearms without needing to visit an FFL, have long been a topic of debate. This morning, an anonymous TFB reader provided additional information pointing to the ATF visiting end users and requesting the forfeiture of certain Polymer80 kits.

The reader stated that on the afternoon of December 10, 2020, they were visited by the ATF and were requested to surrender any Polymer80 kits. The ATF took custody of the Buy Build Shoot Kit and provided them with a receipt for the property. In the “Basis for Transfer or Seizure of Items” box, the ATF agent wrote “Polymer80, Inc. Investigation”. The email to TFB stated:

They are also going after customers. Had ATF at my house approximately 1pm yesterday telling me I need to surrender my P80 or he would return to raid my house with a warrant. Enclosed is my surrender sheet for proof. If anyone purchased a “Buy, Build, Shoot” kit from them they will probably be hearing from the ATF as well.

The Polymer80 kit known as the Buy Build Shoot kit comes with all the parts, tools and jigs needed to build a working firearm. Federal law allows for non-prohibited persons to build working firearms for personal use. A serial number is not required unless the individual decides to sell the home-built firearm at a later date. A Federal Firearms License (FFL) is required if an individual builds firearm(s) with the intent of offering them for sale. At that point, other regulations like a firearms transaction record may be required as part of federal law.

The basis for the initial raid at Polymer80 and the forfeiture of Polymer80 kits is still unknown. We’ll keep you updated as the story progresses.

The fact of the matter remains.....GCA language revolves around "Readily Converted" and ATF is going to have to argue that a P80 frame is "Readily Convertable".........and thats not gonna hold water

Of course it's not going to hold water, but not in court. Getting justice is awfully hard these days, and going against AGs and feds with unlimited budget, it's a game of numbers to them. As long as enough people loose, it's worthwhile tactics.

I think that basis is exactly the result we are seeing, i.e. terrorizing law abiding citizens into never touching that shit. Enough of these cases will cut down on people building. Some people would build no matter what laws are, but they are very small percentage. The main goal is affect enough people to cause this effect of terror. Yeah, ATF are basically domestic terrorists and big part of that strategy is to keep the fog of war as far as their evaluation criteria goes.

But the Buy Build Shoot Kits, which are advertised as having “all the necessary components to build a complete...pistol” weren’t submitted to the agency for approval, according to the application for the search warrant. These kits can be “assembled into fully functional firearms in a matter of minutes,” the warrant application says."

The ATF’s new "holistic" approach is that individually legal purchased objects can be assembled into an illegal firearm "in minutes". Most take a "couple of hours" to build a gun from a Polymer80 80% casting, once all the parts are acquired. If Polymer80 sent your kit in three shipments a week apart would that be OK ATF? If they left one part out with which it would not function, would that be OK ATF?

It’s coming - sure, you can have an AR15 and 30rd mags but not at the same time or put them together to shoot.

10,000 Ghost-guns recovered in 2019? Impressive, but out of the 1 million plus ATF gun traces, that’s < 1%. Did crime go down? Nope...good job ATF.

who are we kidding? The NFA is a "tax" where over $200 you go away for 10 years. 8th amendment? We are so apt at twisting reality, it's no wander our house of cards/lies defies laws of physics.
 
Maybe, maybe not. Several gangbangers in the mASS locale have come up with P80 guns. Yes 99% of the "builders" are folks like me that want to feel like they accomplished something. Isn't that the way with most gun-related issues. It's a few bad apples (who will NEVER jump through hoops) that force the rest of us to jump through stupid meaningless hoops.

I don't see that it's the bad apples forcing us anything. It's actually the politicians and electorate who tolerates them, and people these days will tolerate a whole shitload, while majority stays silent.
 
The Bartley-Fox law has been around since 1975. Mandatory 1 year minimum sentence for illegal firearm possession. I looked but couldn't find the stats (probably by design), but virtually no one has been prosecuted and jailed under this law.

Why??

Because it targeted the actual people that it should. The politicians have no stomach for actually locking up the people that should be locked up....

If they aren’t making more laws, and putting more “offenders” away, they no longer have anything to do.
When government service becomes a full time job, or even worse, a career, overreach and thus tyranny are imminent.

I think this is just a shot across the bow in order to flex their muscles and see what they can get away with. It is also an adept political move that sends signals to the incoming executive branch: "Hey Biden administration! Look, we are on your side! We are ready for the gun grabbing! Once you are sworn in, give us support and money!".

Maybe someone can explain how the end user (who is not otherwise a prohibited person) is getting dragged into this? It's not like they're buying a suppressor or the like. If there's a beef it's between ATF and P80. "Malicious prosecution" comes to mind.

No. They determined that the complete buy, build, shoot kits with everything you need are firearms. Not 80% lowers by themselves. Still BS, but different than what you said.

Right. That's exactly why you have to go to trade school, apprentice for seven years and then obtain a general contractors license in order to buy the "All In One Plumber" kit at Home Depot.

Then they should raid HD and Lowes, because they sell everything you need to build a shotgun. No special tools needed, you can even build it while walking around the store.

They also sell nice big sheets of metal = 0% lowers.

Add some stump remover, charcoal and sulfur (not sure if HD carries that last, but Walgreens/Walmart would) to the Homer Bucket and you can even make the powder to run it.
