You guys are thinking about this too much. You're talking about laws from the point of view of someone who actually understands the law and is familiar with the device. Congress doesn't know what the **** they're doing, they'll outlaw them with no real enforcement plan because enforcement/confiscation is hard. They'll ban the sale, maybe possession will be become illegal or not and that will be that.
