To the elected delegates of the Commonwealth of Massachusetts.

The following is in regard to the Attorney General Maura Healey's notice given on July 20th of this year to the people of Massachusetts regarding certain types of firearms commonly owned by our citizens.

If you allow Attorney General Maura Healey to rewrite already written law without legislative due process you are condoning such an act.

An act that without due warning has made possibly hundreds of thousands of people in Massachusetts felons overnight.

What do you imagine will happen if diplomacy fails them?

Is that something you would want on your conscience?

Please support Senator Tarr's Act to Protect Due Process.

"Laws that forbid the carrying of arms are laws of such a nature. They disarm only those who are neither inclined nor determined to commit crimes. Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man."
-Thomas Jefferson, Commonplace Book(quoting 18th century criminologist Cesare Beccaria),1774-1776

"The right of the people to keep and bear arms shall not be infringed. A well regulated militia, composed of the body of the people, trained to arms, is the best and most natural defense of a free country."
-James Madison, Federalist No.46, January 29,1788

"They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety."
-Benjamin Franklin, Historical Review of Pennsylvania, 1759.

Letter to Support Senator Tarr's bill

Given the new bill being introduced by Minority Leader Senator Tarr, which is being circulated, I have re-written the letter to focus solely on this new bill based on recommendation from GOAL and those touch with the Legislative leadership. We have been asked to disregard HD.4949 and SD.2637. Again this is just my take on things as an example.

Dear Senator / Representative XXXXXXXXXXX ,

As a constituent I am asking for your vote to support for the following Act. While we applaud the Legislature for periodically reviewing and improving our written laws, we ask that you support the proper process to do so. We ask that you inform the Attorney General that it is not acceptable to circumvent our legislative process, especially for such serious and far reaching matters of law and public safety.

XX.XXXX: An Act to Protect Due Process and Strengthen Public Safety
will prevent the Legislature’s roll to define and update laws from being usurped or changed without due process; and will strengthen penalties for those who break firearms law.

A “YES” vote returns rightful authority and control to define firearms law to the Legislature where it belongs. It removes perceived authority to change law which could create confusion and unforeseeable legal, economic and safety consequences. It ensures that the proper legislative diligence, party representation, and due process is adhered as is expected by our state’s system of government
.
A “YES” vote strengthens public safety by increasing the monetary fines and penalties of incarceration for unlawful possession of a firearm or one used in a crime. It strengthens firearm law enforcement and the ability to remove violent criminals from our neighborhoods.

A “YES" vote provides a clear, constructive and inclusive process for the Attorney General, Governor or Executive Office of Public Safety to request a material change to firearms laws.

A “YES” vote removes the recent threat of prosecution against lawfully licensed firearm owners who in good faith purchased, sold, or transferred items in accordance with written Massachusetts laws.

A “YES” vote reconfirms the written Massachusetts Assault Weapons laws that have been clearly defined, vetted, and enforced for 18 years. It repeals vague changes instituted without legislative input or process which have materially created new de facto firearms law - making most rifles and possibly handguns purchased legally since 1994 now illegal to own, transfer or inherit.

Thank you for representing our concerns.

Sincerely,
