if someone barges onto my private property, with no warrant and no actual reason my response to any questioning would have been "get the **** off of my property, guests are welcome here by invitation only and the property is posted. as you are nothing more than a human being i suggest you follow MY rules on MY property."

this is america, grow some ****in balls and tell em to eat shit.

MSP comes up my 3/4 mile long driveway and harassed me for shooting well within my property, i holster my weapon and he gets out of his car like frigging super mall ninja ball blower and points his ****ing gun at me. "STEP AWAY FROM THE TAILGATE!!!!". ive got all my gear on my trucks gate, i dont move. my poor pop comes out as i start shouting at this a**h*** "you had better put your gun down and get the **** off of this property, right now!"

take zero shit off the gestapo.

Oh....and in they were "responding to an alarm call" (not returning form an alarm call), why the hell did they waste time shooting the breeze....shouldn't the alarm have taken priority?

I think its funny a couple of guys in this thread talk s**t about the police but when something little happens they're the first ones to call the cops (COWARDS), love people hiding behind the computer. You guys dont know the reason why they show up and certainly dont answer a question right of the bat with "do you have a warrant to be on my property" that tells me that you have something to hide. Don't get me wrong I'm all for rights i think this county is taking them away but thats the wrong way to go about it.
 
I got into some trouble as a youth......I got hung by what I said to the police in general conversation. In the end my lawyer
Pulled me aside out side the court room.....next time no matter what when it comes to police even if you did nothing wrong
ID yourself and shut the **** up....period.

Ohh yeah keep the gate locked....
 
The OP needs to ask for a copy of the report of this incident. I will almost bet that there is no report and the barracks cmdr or shift cmdr don't even know that this happen.

If a report actually does exist and a copy is obtained, it will be interesting to say the least what their interpretation and recording of the encounter was. Chances are high that it doesn't resemble in the least what you've reported here.

I'd lock the gate securely in the future, physically block the road if possible to prevent any vehicular traffic from passing, temporarilly post it as private property if its not already and post a phone number for them to call if they're really that interested in going fishing.
Make them at least wait for you to respond in your own time frame, not theirs instead of being able to ambush you in the middle of your enjoyment. If that pisses them off, tough shit! They had no reason to be there anyway other than their own curiosity and ego.
 
I think its funny when people act like bitches. i dont even have so much as a speeding ticket on my record, you pop up on my property uninvited odds are you are there to **** with me. Do i have anything to hide? certainly not. but i do want one thing, to be left the **** alone on my personal property that i pay for with my hard earned dollars. The right and wrong way to go about it is for the person to decide upon the situation reaching critical mass.

They said they say a suspicious truck that was the reason and bullshit one at that. PJ had every right to question why they were on his property with notifying him first. They were trespassing plain and simple, you have rights as property owner and heaven forbid he actually use them. I guess if he had been doin nothing wrong he shouldn't have to worry about jbt questioning him.

Short answer do you have a warrant ? No you're trespassing please leave my property

Ignoring the silly responses, here is what I would do if I were fortunate enough to have a big lot of land where I could shoot. I'd make sure that the gate is locked at all times. If a friend shows up, take the extra few minutes to go up and let him in. I'd also clearly post the land as private property and that there is an active shooting range. Anyone who crosses onto your property does so at their own risk.

That's my thought. I would also suggest that it might be worth a couple of hundred dollars to talk to a lawyer to make sure you are doing everything you should to protect yourself. A few hundred now could save you thousands later.

They are representing the authority of the local government. Getting bored isn't an excuse to violate someones rights.

Whatever... he was in his rights to ask for a warrant. He was asserting his rights, only someone who wants to abuse power would think otherwise.
 
You know guys, as a cop that was on a lot of private property, I always was able to "Invite" myself in. With that I mean I would go up the road and when I got there would exchange pleasantries. Chat for a bit and leave. If there was problem observed, I already had reason for being there. As Shots being fired in the woods as An EPO was probable cause.

Plus the statute in Ma. Sayes that an EPO may crossover any lands whether or not covered by water, in the performance of thier duties. There is also case law that supports that.

I am totally ok with this approach ... "... would exchanging pleasantries". The tells me that your a community police officer, not a thug. Your approach shows respect for private lands, and the rights of the people.

Barging in, threatening everyone with guns drawn, is escalating the situation. The fact is that owning firearms is LEGAL. The state police in MA and CONN both act as though they're on an episode of NCIS everytime they encounter one.

Do you think if the guy's attorney were present he'd have asked anything BUT, "Do you have a warrant?" Get real! Lots of cops walk/shit all over people on a regular basis and only stifle themselves when they meet resistance which they know will bite them in the ass if they persist, like an attorney who knows the laws inside and out far better than them and will make a case out of their bad behavior. Asking for a warrant would be the first thing an attorney would ask for, why would the property owner not ask the same thing Immediately?

And, if its my property I can "hide" anything I want to. There's a guy on this board that makes a living building things to hide possessions, what part of "private property" do you not understand?

Three, four years ago there were a lot of Break-Ins in a Cambridge neighborhood. An alert neighbor saw some black men wandering around one of the homes, trying the doors and windows, and called 911.

The Police arrive, and next thing you know Skippy Gates is giving them a ration of crap about his Civil Rights, Racism, blah blah. No appreciation whatsoever for the fact the Cops were there to potentially save his sorry ass from some burglars.

I'm no cop, but if I were, next time there was a report at Skippy's address, I'd grin and keep sipping my coffee.
