Healey "closing the loophole" letter to gun dealers

OK, in the name of sanity, her BS does say that the offending weapon has to meet either the similarity or interchangeability test and be a rifle or handgun that yadda yadda yadda. The question is whether handguns meet the similarity test. How far into la-la land is she willing to stretch "similarity"?
No one really knows. It could easily be argued that semi-auto handguns are illegal
 
Below is a letter I came up with that I intend to send to my reps and the Governor. What do you guys think?




I am writing this letter to express my utter outrage at the obvious overreach of the Attorney General, Maura Healey, regarding the re-interpretation of the Massachusetts Assault Weapons Ban. This re-interpretation has unilaterally banned firearms that have been legally sold and possessed by law-abiding citizens for over 20 years.

The Attorney General’s reasoning is flawed on its face. She is relying on the words “copy” & “duplicate” as they appear in the definition of an “Assault Weapon” under MGL Chapter 140 Section 121. This definition, in part, states “and shall include, but not be limited to, any of the weapons, or copies or duplicates of the weapons [emphasis added], of any caliber, known as”, and goes on to list a series of specific firearms manufactured by specific companies. The Attorney General has unilaterally taken it upon herself to redefine the words “copy” & duplicate”. She has invented a so-called “Similarity Test” as quoted below:

“Similarity Test: A weapon is a Copy or Duplicate if its internal functional components are substantially similar in construction and configuration to those of an Enumerated Weapon. Under this test, a weapon is a Copy or Duplicate, for example, if the operating system and firing mechanism of the weapon are based on or otherwise substantially similar to one of the Enumerated Weapons.”

First, this so-called “Similarity Test” appears nowhere in the General Laws. It is purely an invented idea by the Attorney General. If the Legislature wanted a “Similarity Test” included in the law, the Legislature would have included it.

Second, by inventing this “Similarity Test”, the Attorney General has re-defined the words “copy” & “duplicate”. Based on numerous sources, the definition of “copy” is “an exact duplicate”. And the definition of the word “duplicate” is “an exact copy”. These words do not mean “substantially similar”, as used in the above “Similarity Test”. The words used in the statute are basic, plain, simple words. There is no reason to think these words mean anything other than their Plain English definition. Since when does the Attorney General have the authority to change the definitions of the most basic of words in the English language?

As a result of this, the Attorney General is threatening criminal enforcement based on this re-interpretation. She is threatening to charge otherwise law-abiding citizens and/or business owners with felonies.

This move by the Attorney General is clearly an over-reach of her authority. The Attorney General is attempting to re-write a statute. I urge you to oppose this illegal action by Maura Healey and remind her that the law-making authority falls to the Massachusetts Legislature, not to the Attorney General.
 
GOAL does what they do. Without them your guns would have been gone long ago. We can't even get a measly thousand people for a protest. As soon as someone suggests one we get the old "I have to work" excuse. Then when someone organizes one after work the excuse turns to "nobody will be there".

What's that saying? "The Lord helps those who help themselves." Everyone relies on GOAL to show up at the meetings and fight the oppressive bills. And they do that. But they can't do this all alone. Obviously supporting them with money helps. But when you get a a few people to show up at an event there is no strength in those numbers so it almost seems futile. If we don;'t care enough to take a sick day or a p-day or a v-day then I guess we really don't care about our guns.

To all those who suggest moving to a "free" state I will say the same thing to you as I say to illegal immigrants...fix your own country....We need to fix our own state. If we give up on it...well...gun owners everywhere lose. This is the front line. We're on it. It's up to us.

We shouldn't be focusing only on gun owners. Of course this directly affects us. But it ultimately affects the freedom for all. We need to get that message out there.

You are absolutely right. GOAL is only as strong as the public showing backing them and/or the issues. Even if everyone sent them their life savings, if noone shows up publicly then GOAL only looks like a small set of people complaining about something. However, if 10,000+ people show up every Wednesday for months that would be a much bigger pucker factor for the politicians.
 
In the time it's taken for everyone here in this and other threads on this issue, to read thru and post stuff etc, if you add up all the combined time spent, hundreds of emails /texts/ calls etc etc could have been sent.
Instead everyone will log on to NES and bitch about not having the time to protest (etc l... Meanwhile I took a day off from work and was one of the FEW at the Wilmington public hearing a few years ago.

I'm signing off from posting/reading etc anything on NES immediately that doesn't concern this outright violation of my Constitutional rights and will only read and post about THIS issue, period. No funny pics, no sarcastic posts, no "other topics", no Trump stuff, no NES Karma "in" posts, etc etc etc.. and spending my time fighting this...
If people here think this isn't one of the most egregious unconstitutional despicable moves by the filthbags in power then you deserve to be disarmed.

And I'm giving even MORE of my weekly paycheck to Comm2A from this point forward. And I'm NOT wasting valuable time reading or posting to anything else, today and until this is overturned.

I'm 100% serious.

So at the end of the day it comes down to money. If any of the manufacturers send parts or firearms that are banned they'll get sued by the state, likewise with the FFL's. And they won't be able to afford to pay a lawyer to defend them from the endless funds of the state.

And guess who's paying for the MA lawyers to sue them? We are. Our tax dollars will pay for the state's lawyers. That's ****ed up.
 
I am sorry I an out of stater so I don't know much about Baker other than the fact that my dad who lives in MA voted for him and that he is "Republican". I would think a "republican" would stand for the constitution. I guess I am wrong.

Like I said in #602 we need to take this to the streets if this means to the state house then we need to. Sitting on a website bitching and moaning about this isn't going to help us. If we show up in the thousands then we can't be ingorned. Someone will take notice and if we have to show up every day for weeks then we need to do this.

And people should be trolling her twitter.

Burner phone, 10 minute mail for the verifiable email address, and fake identity. Then call her whatever you want and tell her what she can do with her "guidance".
 
Hi all...new to the forums and had a question. Did not have the time or $$ to go out yesterday to make an AR purchase. Does the new ban limit the sale of all AR TYPES new & previously purchased or am I able to buy one that was owned by a Mass resident prior to July 20?
 
A second article was on the front page of the Globe today. In the article Govenor Baker is said to support the gun ban and th AG.

I couldn't find the article electronically to quote it but I am on vacation in the eastern part of the state and read it.

keep in mind I have no idea how getting this over turned would work but it might be worth it to put that money aside to fight this when its figured out the best use of funds like that.

We need a couple hours' break for people to come in off the ledge, and catch up on the 2600+ posts before posting more. Many of the same questions keep getting asked, and nobody has the answers so it's all conjecture.

The only way this would work is if literally every single shop came together and took legal action as one entity. Asking one or two shops to do it alone is a tall order.

We need to decide where we want to be. Do we want to sit on the highway to make our point? System overload is already here. All European countries are maxed out. Their security structure is crumbling down. Our structure is nowhere near that yet but it shows severe lack of intelligence. We are missing smart people. What we are doing is not smart. Not only on a local level but also on an international level. I would like us to get involved in positive things. There will be plenty of opportunities.

GOAL and NRA are what they are. Thanks for them,but, as any organizations with the time, they became stale hobby organizations.

We need a new organization with the new mission.

This is why I'm saying we should just go around randomly dropping brass everywhere.

Drop brass in front of the library - some liberal idiot calls the police and the whole place goes into lockdown. How's your town budget now? Why didn't the police respond to the breakin happening on the other side of town? Because ten cruisers locked down the center of town over a piece of brass that's why.

Rinse and repeat over and over and over again until the system breaks.

This is how you break the system.

This does not need to be coordinated - and in fact should NOT BE.

No clear line of accountability. No clear lines of attack. Just constant screwing with the system. Over and over and over again.

NY, MA And CA have gone full retard but I do believe they are just the first to fall... I'm in RI so this is way too close to home... At this point our only hope is electing Trump and hoping he keeps his promise and appoints pro-constitution justices and this gets dealt with in the courts...
Actually, I believe this was a backed idea by the white house, a trial to gauge response. Look, if it can happen in MASS.,why not 10-12 other libtard states with conspiring AG's, like next week. Now, 25% of the country is under a firearms ban. The supreme court is at 4-4 with a 50-50 shot of Cankles becoming president. If she does, all 50 states will be ordered by her AG. Add another commie justice and 2A is gone. Imagine Crickets going for 5-700 bucks!! It will take at least 6-9 months to get this before a judge in commie states, if at all. If MASS is to stop this, an immediate injunction needs to be put in place by a Federal court, a state court isn't going to breath on this.

Today is the day that I'm officially deciding to do whatever it takes to permanently move away from this socialist shitshow completely. I've had my complaints about our crumbling infrastructure, taxes, high cost of living, virtue signaling laws (banning the sale of cigarettes to folks under 21, anyone?), mandatory healthcare, and already-present and convoluting gun laws prior to yesterday, but banning the sale and ownership of semi-automatic rifles without any sort of checks and balances seals the deal for me. I've had it up to here with Massachusetts. I'm done. Dixieland, here I come.

Although I am biased (as a board member), I believe that Comm2A has the expertise, connections, and ability to assure that any action is followed through to conclusion - something that is lacking in loose coalition of dealers.

I have donated in the past, but I upgraded to a diamond sponsor because of this. I encourage all to donate what they can afford.

And, if you become "suspected" of doing this, remember that the firing pin; extractor markings; breechface markings and.or chamber markings can be positively matched to your gun or other brass in your possession.

This has bad idea written all over it.

Martin Luther King understood this. He certainly did not use only those tools that were provided to legally express discontent such as writing his congressman.
 
I know we are all calling our reps, senators, and the governor, but what is it we are asking them to do and what authority do they have over Healey? Are we asking them to actually create law around this? Is this not opening up a can of worms? Perhaps this was Healey's goal in the first place: get us to push for legislation on 'gun violence'.

We will be so happy to keep our 10-22s and give up our ARs as a 'reasonable compromise.'
