ATF Proposed Rule Change for Frames and Receivers

So this is an interesting bit from the fact sheet:



My reading of this is that they are requiring serialization of complete build kits. These are kits that include an 80% lower/frame plus all the parts (FCG, slide/barrel/upper, LPK, etc) you need to complete the build. If this is actually what they are doing, it would mean you could still get 80% lowers/frames by themselves, just not as part of a complete kit. Notice the continued reference to “kits” and not an individual component.

I think the fact sheet is dumbed down for the public and it's going to apply to all < 100% frames/lowers.

So Does that mean every FFL that wants to sell these now hast to get out 07 license because you can’t serialize without a 07 license correct??

Correct. It seems they are saying it's a firearm if you include the tools to make it. Which is very strange as it would essentially be a 1A violation to ban sharing the instructions.

Sounds basically like you cannot sell 80s with other parts, tools or instructions. There doesn't seem to be any definitive alterations to what an 80 is or making 80s by themselves firearms.

There is definitely a change to moving PMFs around. If you give your gun to a dealer or gunsmith, they are required to serialize it and report it to ATF before giving it back.

It's tough to say without getting deep into the vague wording.

Also very strange because they’ve already been putting out that guidance to 80% manufacturers. Polymer80 had to stop selling their complete build kits. And with 80% Arms, their GST-9 frame had to be sold separately from the jig and metal parts. But, they could still be shipped together. They just couldn’t be one product. Though, it seems that the ATF is taking it a step further.
 
What really grinds my gears is this whole “rule” thing… We’re supposed to be a nation of laws. Like from schoolhouse rocks our bill is supposed to become a law. Not just a reinterpretation of anything you don’t like. Or like Biden using the defense act for minerals for rechargeable car batteries like it’s a matter of national security.

The executive branch has way too much power..
This whole Covid thing is another prime example. It’s such an emergency we don’t have time to sit down and come up with a legitimate plan and pass it the right way. The Senate and the house should’ve sat down figure it the f*** out and approve it legally. And if they want to argue over it and not do it then fine we don’t have to do anything about Covid and we can just deal with it by ourselves. They’re all a bunch of scum bags

The rule requires you to be able to present an issued permission for an every right you think you’ve got. It is quite logical, from a perspective of the executive branch.

The Covid stuff, was the same way even for states - even in freakin *NH* - months and months into governor's orders it still wasn't turned over. Now let me qualify that, I really like Sununu *usually*, and maybe it was partly due to other lazy ass politicians who were basically just kicking back and letting him take the heat instead of putting their heads together to take it over, but whatever the case it was freakin lame. I 100% agree that initially, in a real emergency, it's alright when otherwise constitutional for a governor, president, mayor, whoever, to make some temporary rules/decisions because you do not have time for 50 or 200 people coming in cold to be squabbling for hours/days/weeks, but after a month really it's time for actual government process.

Yes this rule making stuff is garbage, the fed government is too damn big, and this concept of instilling the ability to make what amounts to law on the fly, by various federal agencies, is total bullshit - and sadly it's been going on a long time.
 

ATF is at it again—rewriting federal law to create new gun control laws.

What is About to Happen?

Tomorrow, the Biden Administration is expected to publish its final rule to combat “ghost guns”—or privately made firearms which are currently legal right now.

The new rule will be entitled “Definition of ‘Frame or Receiver’ and Identification of Firearms,” but it will do far more than the White House is pretending.

GOA will analyze the differences between this final rule and the previously published proposed rule, but here is what we know already. The rule will:

  • Allow ATF to end the online sale of gun parts at will (as Biden promised on the campaign trail).
  • Mandate the serialization of many gun parts, forcing Americans to undergo a background check for a new legal “firearm” in order to repair or buy replacement parts for their guns.
  • Require that 100% of Firearm Transaction Records from gun stores dating back to 2002 end up in ATF’s billion record gun registry.
You heard that right.

Not only will this mean you have to do multiple background checks to build or repair a gun…

And not only can Biden’s ATF ban the online sale of gun parts without a new law…

This new rule is about expanding an already billion-record gun registry to eventually include EVERY SINGLE SALE at EVERY SINGLE GUN STORE since 2002.

This is pure gun control—ultimately people control.

I have to ask, wasn't this the ruling before? If I remember correctly if you intended to sell your DIY, it was required to be Serialized beforehand, and technically you are not supposed to sell them as the DIY guidance was for personal consumption.

So have they basically regulated out the bundles that have been sold that include the slide and barrel and other stuff.
