They resolved A split with Bruen however they created a completely new standard to be applied in doing so - that standard was not fully described and leaves a lot of room for circuits to interpret the boundaries of what SCOTUS will accept.

In Caetano the issue was that a stun gun was completely illegal so her having an LTC didn't factor in.
SCOTUS focused on the lower court's error in the opening statement:

They then show how the lower courts incorrectly argue that stun guns are not covered in three ways, all of which were well addressed in Heller

The final statement directs the lower court to find that stun guns are in fact included in the 2A.

Once SCOTUS declares stun guns to be included in the 2nd then Caetano could not possibly have broken a law since nowhere else was the possession regulated in Mass law.

I've always read Caetano to be intended as a slap down of the Mass SJC. For that matter a case remanded to a state supreme court is different than one remanded to a lower federal court.

I can't watch Armed Scholar. It's like watching Patrick from Sponge Bob. He's just not dynamic at all.

I tend to watch Langley Outdoors most often b/c his schtick is predictable so I can FF easily to the meat of the story.
 
I used to watch him every night, but stopped that he was just pedaling panic on everything. Never a constructive thing to say, just ranting. Then the next night, he'd rant about something else.

All msm news is basically fear porn, just the sub kinks and fetishes change. And if you're here, you've already seen anything worth seeing by the time the tv gets turned on.
 
He's right a good amount of the time. But EVERYTHING is panic and tragedy. It's no better than watching General Hospital, WWE or professional sports. My life doesn't revolve around constant issues and tragedy.

(Funny aside - my wife's aunt was all up in arms about TB12's divorce. It was as if he was her nephew or something. WTF??? "Oh I wish he would go back to that nice Moynahan girl. She was so nice." ROFL!!!!)
 
I don't care if he goes back to her or not, but I always thought Moynahan was way better looking than Gazelle.

You know, that judge might not be the best for this case. I'm thinking they should run a urine test on him and check his social media. [rofl]

I still have a bit of wonder of WTF they were doing. Maybe just an FU while delaying the inevitable. Or, as I've posited in teh past, they be crazy. This guy is hopefully gonna s-can the whole law. That way NYS can appeal and get further B-slapped. More appeal. More B-slap. Eventually, 2 years form now, C-Tom will pull a Thanos on them all.

The state of New York has 3 days to make an emergency appeal to the second circuit. At the end of 3 days the temporary injunction goes into effect. But I'm willing to bet that the CA2 just watched a GVRing to CA1 and are probably not ready to repeat it. If they said "yeah the law in constitutional for no reason whatsoever" then it's stupid. I'm pretty certain that CA2 isn't going to be reaching into a bag of tricks to find a reason to keep it, but who knows. Liberal judges would quote comic books, science fiction movies, anything to justify an infringement even if they knew it wouldn't survive en banc or scotus. But thankfully Bruen makes it clear what they can't do and that's rights balancing and intermediate scrutiny. Thank goodness for the wisdom of Clarence Thomas.

The Morin case as it was originally filed had to do with the law preventing anyone convicted of a gun crime that has a potential prison sentence from getting an LTC. I’ll ignore the whole FID, PTP stuff it devolved into. That law is still in effect until the First Circuit comes to their senses, which might be a while. It’s MGL 140 131 (d)(iii)(D):

Thank you for confirming this. This is what I thought, yet they said things MUCH TO THE CONTRARY. I guess that is slightly to be expected. Funny how it was news here on Monday, but took until Wednesday/Thursday before the TV/newspaper news picked up on it, and then THEY GOT IT WRONG.
