Massachusetts Legislature Voting on Anti-Civil Rights Bill TODAY!

Here's what I see.

The bill passed by the house replaces "may issue" with "shall issue" and removes reference to restricting licenses. It also sets the renewal period to 3 years from the date of issuance (assuming each renewal is a new issue and current dates of expiration remain valid).

The text regarding suitability can be found here:
SECTION 45. Said section 131 of said chapter 140, as so appearing, is hereby further amended by striking out, in lines 152 to 157, inclusive, the words “: (i) reliable and credible information that the applicant or licensee has exhibited or engaged in behavior that suggests that, if issued a license, the applicant or licensee may create a risk to public safety; or (ii) existing factors that suggest that, if issued a license, the applicant or licensee may create a risk to public safety” and inserting in place thereof the following words: - reliable, articulable and credible information that the applicant or licensee has exhibited or engaged in behavior that suggests that, if issued a license, the applicant or licensee may create a risk to public safety or a risk of danger to self or others.
This seems to be a preemptive "red flag" type issue.

The main difference now: You either get a bigboy license or you don't get any license. If you are denied a license but are not a prohibited person, in other words: if you are denied a license based on this language in the proposed bill, you have some appellant rights if I understand correctly.
 
Supposedly, it also establishes the standard of "dangerousness". For example, if someone takes the 5th a license can't be denied on the basis of "refusing to cooperate in an invesitgation" unless the issuing authority can explain why this indicates potential dangerousness on the part of the applicant. This turns Moyer on it's head, assuming a court is willing to follow the new law rather than relying on a precedent that applied to an earlier, and replaced, section of MGL. I expect the court will continue to apply Moyer because they prefer the "it was like that when I got here, not our problem" approach to LTC appeals.

So it's off to the senate with this legislation and I have to call Jason Lewis now. What is the exact bill number I want him to oppose, can anyone tell me this?

Does it simply go from H5046 to S5046?
He’s creaming his pants to vote yea on this. I think the only thing that would excite him more is if he could amend it to require mandatory gender transitions for children in elementary school. its great when he’s up for re-election and he sends a bunch of trannies around to do pamphlet drops throughout his constituent neighborhoods. it’s like the circus is in town and the bearded lady is going around to spread the word.
 
I came down on Brad Jones earlier for supporting this travesty, deservedly so.

Today I heard on the Howie Carr show that Brad was actually out collecting signatures for the Illegal's license question. I have to give him some credit here. I'll have to shoot Christopher an email as well supporting Brads active position on this.

Most likely. This works for our side, if our side works for it.

They always pass stuff on midnight Saturday at the end of session.
Someone needs to put in the Katrina language SOMEWHERE. If there is a bad storm, hurricane, tornado this summer/fall, they NEED to add Katrina as a hasty last minute, unnoticed amendment to one of those emergency bills.

I renewed this week. The Licensing officer wasn’t amused at the prospect of doing twice the work.

I wonder if there is an objective to this that we have yet to see. It seems like they are deliberately trying to blow up the licensing system by doubling the work?

I just think democrats are too stupid to think about the consequences of their actions.

Kinda like forcing everyone to buy an electric car without realizing what that would do To our already f***ed power grid. Magic unicorn power!

I have no doubt that the Godless Dim pols are aware of the CF that is our LTC licensing system and that they see it as a big plus that doubling the workload will screw-up and slowdown the system even more... all for nothing. :mad:

I don't think they want to turn America into a third world shithole because they wouldn't want to live there. They want a Socialist country controlled by the Leftist, Professional Elite which would consist of Academic Elitist and Govt. Stooges devoted to the cause of rooting out all Conservative, white resistance. The Hispanic migration to the GOP is sending shock waves thru the Leftist Elite even as the Southern border is allowing Millions of illegal Hispanics into the country.

I see the Senate rejected the language to cut the license from 6 years to 3..and is sending it back to the House..

That is GREAT NEWS!

Now, how do we see this through? Call our state reps again?

Or, will this entire thing just fester and die on the vine?

OR, will they add some other garbage last minute? Are they in session over the weekend? If so, is GOAL there to guide them? Guessing that none of this is unplanned.

They most certainly are in session all weekend since they have until midnight tomorrow to get this done, on top of getting 8 other bills to the governor. Tomorrow they'll definitely go until midnight so stay tuned.

There's also some political conflict between the House and the Senate right now over a ton of stuff, which has the possibility to affect their ability to move on the gun control language in the way that its proponents would like to see reintroduced. Second to that since tomorrow is the last day of formal session, they don't have time to come back and override Gov. Baker's vetoes. This means that they need to be very deliberate in what they send him and are likely softening anything that pushes too far to an extreme.

Is there any ability for people to go into the Statehouse to talk to their reps? Just use listed numbers? Anybody have that list handy?
