Linsky's Amendment is back in play - Call your rep NOW!

Here's the full text of Tarr's amendment included on the senate version of the bill.

I hope everyone recognizes at this point that we are down to two options, A. Linsky's version or B. Tarr's version.

Well aware of that and need to back Tarr's version, so that we don't have EOPS controlling the "maintenance" of our firearms:

511 SECTION 51. The Secretary of Public Safety shall promulgate regulations by January 1,
512 2018 concerning the allowability of maintenance and enhancement of rifles, shotguns and
513 firearms consistent with the intent of this section.

M senators aid ,had a short one line responce. “I’ll let the senator know”.

my house reps phone went unanswered. After 30 rings.

so I sent an email Expressing my disappointment at his not doing anything to stop this mess.

both are rated A by goal.

Did anyone point out Ma is the only state to fly off the handle to get this b.s. passed ?

like a bunch of frightened children, not leaders.

My State Rep supports Tarr's version but voted for the Linsky crap in the House the last go around.

Id love to know why Tarr voted NO to adopt an amendment that had his language in it.

Perhaps he didn't agree with the modification to the MG license section.

From GOAL’s Facebook page:

10/27 Update. Please continue calling your legislators about stripping the Linsky language from the house budget, H.3979. (see last post for more info)

This is going to come down to which version gets passed and we need to do everything we can to ensure it's not the house/Linsky version. Now that the house and senate have each followed procedure and approved the same bill it will go to conference committee. They will approve the final version between the two and send it to Governor Baker to be signed. He is going to sign whatever comes out of committee.

We should know who is going to be on the conference committee later today and we will need to make phone calls once we do.

It is not that they are flying off the handle it is as Rham said "never let a good emergency go to waste" they see this as an easy way to take another chop at the tree of the 2nd.

From Pacheco's aid.

"Thank you for reaching out to Senator Pacheco on this important issue. The Senate version of the spending bill which was passed last night does not reflect the House language which, as you said, is vague and unclear. The Senate amendment does not impact existing gun owners, and merely sets definitions for bump stocks and trigger cranks, and does not allow for the sale of new bump stocks and trigger cranks after January 1, 2018. Since the Senate’s version of this amendment is much different than the House version, there will be a Conference Committee announced shortly to reach an agreement between the two, and the Senate is adamant that their version of the amendment prevails. Senator Pacheco always votes with the consideration of gun owners in mind, and has always made the preservation of 2[SUP]nd[/SUP] Amendment rights a major part of his legislative agenda. He continues to maintain an A rating from the Gun Owners Action League, and will continue to support the rights of legal gun owners."

SECTION 19. Said section 121 of said chapter 140, as so appearing, is hereby amended by inserting after the definition of “Assault weapon” the following definition:- “Bump stock”, any device for a semiautomatic firearm that increases the rate of fire achievable with such firearm by using energy from the recoil of the firearm to generate a reciprocating action that facilitates repeated activation of the trigger.

SECTION 20. Said section 121 of said chapter 140, as so appearing, is hereby amended inserting after the definition of “Shotgun” the following definition:- “Trigger crank”, any device to be attached to a semiautomatic firearm that repeatedly activates the trigger of the firearm through the use of a lever or other part that is turned in a circular motion; provided, however, that “trigger crank” shall not include any firearm initially designed and manufactured to fire through the use of a crank or lever.

So... we all know what they're trying to say, but isn't firearm specifically described as a "handgun" in MA?

LOL - Was supposed to be "weapon" Ha Ha, and yes you are right:

https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXX/Chapter140/Section121

''Firearm'', a pistol, revolver or other weapon of any description, loaded or unloaded, from which a shot or bullet can be discharged and of which the length of the barrel or barrels is less than 16 inches or 18 inches in the case of a shotgun as originally manufactured; provided, however, that the term firearm shall not include any weapon that is: (i) constructed in a shape that does not resemble a handgun, short-barreled rifle or short-barreled shotgun including, but not limited to, covert weapons that resemble key-chains, pens, cigarette-lighters or cigarette-packages; or (ii) not detectable as a weapon or potential weapon by x-ray machines commonly used at airports or walk- through metal detectors.

Left a message with rep and haven't heard back yet, but she voted for linksys BS the first time, despite her A from GOAL. I think it's time for some new report cards

Sen. Rodriges Voice mail picks up, but he was part of the small group pushing for Tarrs bill last time, so hope hoping to get an update from his office

The way this is going down someone must have told DeLeo the House version passes or his puffy ass is going to club fed. No way Linsky has this much juice over a dumbass virtue signalling bill. The know nothing anti-crowd should be happy with any ban bill. Someone has PAID or extorted for the house roll of used toilet paper specifically for the expansive language.

Let me know if y'all run out of bump stocks up there and I'll bring some up on my next trip to sell.

This is definitely a strategic move by the gun grabbers in power. If Healy's BS has taught us anything, it should be that more broad lawrs can be "interpreted" to mean what ever the hell they want it to whenever they want! See the quote in my sig line...

So this goes back to the Senate again if they push back on the new wording?

Yes, both the house and senate have to vote to agree to the same language.

The fact so much time is being spent on a tiny little amendment thrown in last minute to the budget tells you someone really wants this bad and is either pressuring or paying DeLeo big time for it. Otherwise the legislature would be spending their time on other pet patronage projects and finding new ways to skim pot or casino money into their pockets before the deadline.

house is fighting it:

10/27/2017House Rules suspended
10/27/2017House House NON-concurred with the Senate amendment
10/27/2017House Committee of conference appointed (Sánchez-Kulik-Smola)

Rep. Kulik is usually very pro 2A. Does anyone have info on how he previously voted on this? Or a link?

Just spoke to Sen Rodrigues aide, the short story was he seems to think it will go to committee, neither side will agree or come to a compromise so it will be dropped from the budget bill, and have to stand alone as its own bill at a later date. I hope his asessment is correct.

A quick search shows that All above are listed as A+, except for Spilka who is F, and Sal, who is not rated.

This could be best case scenario. Fingers crossed.

That's very optimistic and down right shocking for mAssachusetts, baker already said he will sign anything that resembles a ban.
I can see the senate version having some pride of work behind it by having clear and concise language, (for the most part). I cannot figure out why the house is pushing so hard for the the vague and possibly outright wrong wording. They just buthurt senate didn't just go with it?

Got live people at both my rep & senator's offices. The aide for my rep said I was first to call and thanked me for letting her know, she says Rep Rogers gets a lot of calls from Norwood & Walpole when stuff like this happens, so prove her right people, light them up!

The aide at Sen Rush's office sounded exhausted, I think she has been taking a beating all day on the criminal justice reform thing they're doing today and I could hear in her voice "oh Lord, not a gun thing today too...".

As always, be polite, firm and informed, but call!

Yes, and use proper spelling, grammar, and sentence structure in a letter to an official. Nonsensical phrases like "you legislatures" are guaranteed to make a sender look like a moron.

Please note this is the correct phone number for Senator Sal N. DiDomenico, 617-722-1650. The number in the GOAL alert was copied incorrectly and is for Sal's fax machine.

Got no idea what happens now...

We get screwed again it is just a matter of how bad.
