The other guy got charged with with carrying a loaded firearm without a license, carrying a firearm without a license, possession of a firearm without an FID card, possession of ammunition without an FID card, armed assault to murder, assault and battery with a firearm, and discharging a firearm within 500 feet of a building.

WTF?

Just an aside; what is this? TRIPLE jeopardy? Same thing has 3 different charges?
It's misleading because of the coding used on complaints but there's the different crimes alleged. There's the basic unlawful possession of a firearm not at home or place of work. That's 18 months mandatory. Then there's the additional enhanced crime of doing an that is the gun is loaded. That theoretically carries a year from and after but you can get probation for that crime. Then the FID charge is for the ammo which has no mandatory time.

What about carrying without a drivers license? Carrying without a AAA card? Carrying without a sense of humor?
 
Every article out there was hot trash. I was able to actually find what they were charged with.

Morris faces the following charges:

Neither person legally possessed the gun. So what? More laws to make it more unlawful? idiocy knows no bounds.

Because mass is weird.... 🤣. There's always been this "charge wall" between having a handgun at home and "about". Part of it comes from the fact that at one point in Mass, there was a peon level device where you were allowed to buy a handgun with a purchase permit, and basically keep it in your house, but you weren't otherwise allowed to just lug it around anywhere unless the movement was covered by an exception in the law. Even though the "Permit to puchase" vehicle is long dead, there's still detreitus left in the laws from it.. .for better or worse.

He had one of his kids hold his beer while he was shooting and driving - charged with delinquency of a minor.

If he was in fact loaded while carrying he’d probably be holding the beer between his legs while shooting instead of having the good sense to let the kid hold it and risk spilling it.

The defense rests.

Since 1975 it's been a misdemeanor in mass to have a gun without an fid card in the home or place of work but a felony with a mandatory sentence to "carry" outside the home or place of work. Don't bother saying nobody gets the mandatory sentence bc many do all the time.
So a guy who is not prohibited but not licensed defends himself from a home invasion. Shoots a guy dead in his living room. 100% legit inhave s every way aside from not being licensed. Does he have a prayer when he gets to court?
In that scenario a person could get a cwof for the misdemeanor so not terrible but also they'd likely get some alternative disposition like pretrial probation.

Slightly lesser charge if it took place in a state that operated bases on logic rather than emotion. That may also have been the case in Massachusetts at some point but not in my lifetime

A great example is the case of the law student from TX who did 26 months for being an undocumented firearms owner in MA, with no other associated crime associated with the gun/ammo charges.
