OK, so adding to stupid question tricks, I'm in CT. is it also OK for us to drive to RI to purchase a long gun or is it just you MASS folks that have struck the deal without the transfer to instate FFL??
And that really is a cat, just a very rotund one!!
 
so i wrote a letter and got a response:

"Thank you for taking the time to send this email. While RI state law does
not prohibit the sale of long guns to out of state residents the federal
government will not allow a background check to be performed on anybody
not from the FFL's state. This was explained to you upon your visit. If
we can be of any assistance in any other way please do not hesitate to
contact us."

100% wrong. I've seen it done many many times. Find a new FFL.

The guy's full of it, I'm sure someone will be along shortly to post the actual BAFTE law or whatever and you can shoot that right back to him.
 
It can happen that the dealer does not want to do the transfer for whatever reason (straw purchase if several people come in together, maybe just smells a rat or whatever) He then makes something up to avoid doing the transfer. Jack.

.[bs1] Ask them to cite the federal law that prohibits them from "performing a background check on someone not from the FFL's state".

ETA: Here's the statute that expressly ALLOWS such a transaction...

18 U.S.C. 922
(b) It shall be unlawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver—
(3) any firearm to any person who the licensee knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the licensee’s place of business is located, except that this paragraph (A) shall not apply to the sale or delivery of any rifle or shotgun to a resident of a State other than a State in which the licensee’s place of business is located if the transferee meets in person with the transferor to accomplish the transfer, and the sale, delivery, and receipt fully comply with the legal conditions of sale in both such States...
