"Hunter" falls from Treestand, sues landowner

JASMIN WAS DRUNK!

There are a couple of developments in the Tree Stand Lawsuit. Depositions are set to be taken October 16th. In pleading filed in court by Charlie Corliss' Lawyer, Mark Mallory on August 15th, ...he charges,

"MEDICAL RECORDS FROM DARTMOUTH HITCHCOCK MEDICAL CENTER SOME THREE HOURS AFTER THE ACCIDENT INDICATE THAT MR. JASMIN HAD A .16 BLOOD ALCOHOL LEVEL."(my emphasis)

On August 3rd, Corliss Attorney Mark Mallory filed the "DEFENDANT'S BRIEF STATEMENT" pursuant to court rules and made the following averments:

On information and belief, Plaintiff, in violation of RSA 214:1. was hunting without a license;

On information and belief, Plaintiff, in violation of RSA 214:1and the administrative regulations adopted under RSA 214:A-2, was hunting without having completed a hunter safety education course approved by the New Hampshire Department of Fish and Game. such course would have educated plaintiff to the absolute impropriety of his behavior in attempting to make use of this tree stand as he did.

Plaintiff, in violation of RSA 214:20, was engaged in hunting activities while under the influence of alcohol and while in excess of the legal limit of .08.


On August 18th, BJ Branch, the attorney for William Jasmin filed a motion to amend the original writ. He writes,

Mr. Jasmin sustained serious physical injuries in this incident and therefore other individuals had to be consulted to obtain information with reference to which Mr. Jasmin was not 100% certain. That has slightly changed the factual circumstances which led to this accident occurring.

Specifically, the undersigned has recently learned that he was under a mistaken impression as to the exact purpose for which that Mr. Jasmin was on the property at the time of the accident.

"That counsel for the defendant has learned that Mr. Jasmin was not actually hunting on the date in question "but was merely scouting" the land for hunting purposes when the incident occurred. Therefore the amendments set forth below are designed to simply clarify the precise purpose for which Mr. Jasmin was on the property at the time of the accident..."
