FPC files motion in first circuit to vacate and remand thier lawsuit challenging the Massachusetts approved roster

Why would you want to vacate your own lawsuit? I don't understand.

The US Court of Appeals for the First Circuit vacated it based on Bruen and remanded the case back to the US district court (a lower court). See 1) below.

On 9/21/23 (about 3 weeks ago), the plaintiffs filed a First Amended Complaint with that lower district court. See 2) below.

It seems that all the 1CA did was remand the case back to the District with vague instructions to re hear it. The order opens the door for another bad decision which will be appealed once again.

This could go on for years.

Possibly, but as mentioned above the Appeals court remanded it back to the lower court in light of the Bruen decision.

In light of the Supreme Court's decision in New York State Rifle & Pistol Ass'n, Inc. v.Bruen, 142 S. Ct. 2111 (2022), the district court's judgment is vacated, and the matter is remanded for further proceedings

They didn’t really have a choice but to do so. It was either remand or rule against us and get reversed by SCOTUS.
