CA - Man Shoots Intruder & Holds Him At Gunpoint

A man shot and wounded an intruder who broke out a living room window to enter the man's home.

The incident began shortly before 1 a.m. Friday when the resident -- a 36-year-old man who was at home with his 33-year-old wife and four children -- reported to the Sheriff's Department that a man was in his front yard kicking his family's dog.

The suspect initially tried to enter the home by forcing open an attached garage door. He then broke the living room window with a hammer that he stole after breaking into the victim's vehicle.

The resident shot the 21-year-old Placer County man in the upper right thigh in the living room and held him at gunpoint until deputies arrived.

Because he hit him in the leg and not a vital organ he will probably be sued and loose the house! Ma and Cali have some odd laws. I have a friend who had someone breaking into his apartment in Dorchester. The thief scaled the outside of the building and fell three stories because the handrail on their patio broke. The thief broke his back when he landed in the front yard of the complex. He then sued and won because the handrail should have been secured to ensure this wouldn't happen. Remember this contractors when you're building if you don't build it well enough for someone to break in you might loose your business!
 
Sounds like he fired a "Warning Shot".
 
California ....the only state maybe worse than Mass...
He'll be fine. I used to live in CA and they have castle doctrine. There's no duty to flee and you can kill the BG so long as:
* He illegally breaks into your house.
* You know he illegally broke into your house.
* He is not a member of the household.

You'll find very few EBR or LTCs in CA, but you can kill bad guys in your home, you don't need a license to buy a long gun or ammo, and pepper spray and brass aren't legally ammo. It's just as bad there, only different.
