I thought the purpose of the law was to fine a murderer like Adam Lanza, $1,000. and give him an extra 1 year in jail on top of the murder charges. /sarcasm.

This question is largely academic. A bar exam question that many in this forum would ace.
The reality is that the majority of judges, prosecutors, and magistrates do not have the benefit of years of mental conditioning and intellectual gymnastics as NES members do.
In Massachusetts the sad fact is when in doubt arrests are made and LTCs are pulled 90 percent of the time.
