RI Officials to Announce Gun Control Bills - Post #10 Update

Wow, I just read that pile of crap and the language is so vague. This is going to the Supreme Court for sure. I fail to understand how this legislation is going to do anything other than punish law abiding citizens and make criminals out of them.

On the second part, do you seriously believe they are trying to stop criminals? Honestly, it should be obvious by now all they want is to ban guns completely through small steps. And they are winning.

Gun owners = political enemies. They are smart politicians. It's us that are attempting to debate with them on 2A rights. We are a nerdy bunch. We lose if we play only political games.

Heller was very limited as to the type of weapon (ruling that weapon types could be restricted by the law, but not setting specific restrictions in the ruling) and to place (in the home): That being said, the key point in Heller was an "in common use" clause. So.... I am not sure the Fat Lady has sung quite yet.

Post-Newtown gun legislation will hinge on 'Heller'
 
Isn't this bill in direct violation of RI's state constitution? It was my understanding that RIs constitution is one of the more liberal ones (no pun) with respect to gun rights, and amending it cannot be done this easily? Sorry, but Im a doctor, not a lawyer.

It would only be unconstitutional if the RI Supreme Court or SCOTUS said so. Until then, it would be binding law.

* Bans on high-capacity magazines and semiautomatic assault weapons after July 1. Exempted are antique firearms, inoperable weapons, rifles or shotguns unable to hold high-capacity magazines, and firearms manufactured before July 1, 1963. Current owners are grandfathered in, although they may sell such weapons only to buyers outside Rhode Island or to someone authorized to possess them.

I would assume the ban on "high capacity" mags is on all weapons, not just on Mags for "assault weapons"?

* Creation of a relief board for those denied firearms based on mental-health or substance-abuse backgrounds. Setting up this board makes the state eligible for federal funds to help it comply with the FBI system.
Federal funds....key words in all of this.

So, from what has been stated (no posting of the proposed laws yet) sounds like they want this wrapped up prior to July 1.

If so, what has your experience been with the AG in issuing a LTC (regardless if you actually have a legitimate reason or not)? I am basically preparing for the worst since it appears I may not make it in time to file my application to the local CLEO before they pass this $hit...

Why not apply in the town you are moving to (which is)?

I have been reading the bills between pauses of my letter writing (I have to pause as I get angrier and I'm trying to to be too offensive) and according to the definition of assault weapons my .22 Sig Mosquito and a Taurus Circuit Judge will be considered "assault weapons"

Oh and don't forget

We need to unite and defeat this assault weapon and high capacity magazine ban. I do think that not everyone is capable of owning a firearm and stricter restrictions should be placed on those with 'mental health issues' - that and the other bills proposed - regarding criminal use of firearms should move forward. If they want to pass something to help us poor citizens then let's tell them to work on that and leave our guns and mags alone. They need to be informed and it will be up to us to do that. I will be putting a list of senators and state reps together so that we can contact them to let them know our feelings towards these restrictions. Good luck. That did zero good here in CT and you have way more actual self declared communists there in RI.

Search and seizure. -- The right of the people to be secure in their persons, papers and possessions, against unreasonable searches and seizures, shall not be violated; and no warrant shall issue, but on complaint in writing, upon probable cause, supported by oath or affirmation, and describing as nearly as may be, the place to be searched and the persons or things to be seized.


Section 22. Right to bear arms. -- The right of the people to keep and bear arms shall not be infringed.

Seems pretty cut & dry to me. Doesn't mention anything about magazines, firearm color, picatinny rails, mental health, etc.

The way this is worded will slingshots and pinball machines be considered firearms now? what are they going to do about nail guns? And if blank guns "expelled metal projectiles " how would they be blank guns? Who writes this S***!

1) People who don't know anything about guns
2) People who think drawing a picture of a gun on a piece of paper is just as heinous an act as shooting someone with an actual gun
3) People you watched eat lots of paste, glue and lead paint chips while you were in Preschool.
 
The new strategy that seems to be emerging is delayed confiscation - allowing non-transferable grandfathering, so there is no mass of people who simultaneously have standing to challenge the taking.

Go read up on Fabian Socialism, we are dealing with patient oppressors here.

Mr. XXXXX, Thank you for your email, I appreciate input from constituents. I have been following the developments since the tragic shootings in Newtown. Since then, there are several bills being drafted in the house of representatives to try and implement some type of "gun control". I will let you know that I have been an avid hunter and sportsman my entire life and recognize the importance of second amendment rights. It is my opinion that no amount of "gun control" would have prevented the atrocities that occured in Newtown.
I believe that law abiding Americans should have the right to own guns, carry guns, and protect themselves and their families. Simply removing these rights does nothing except hinder the ability of the law abiding citizen to protect themselves. "Gun control" does nothing to stop the criminal or mentally disabled from commiting crimes with illegally purchased guns.

Finally a logical response from a Representative. I am not familiar with Jared Nunes, Where does he represent? I haven't finished my letter yet because I'm trying not to be angry in it nor miss anything, but I should have it finished tomorrow and I'm sending it to everyone. I don't care where they represent, but I'd also like to send some possitive letters to the ones who support the 2nd Amendment.
