Out of state purchase, need an FFL?

I have an opportunity to purchase a shotgun out of state. Do I need an FFL or is registering the shotgun through the MA registration portal satisfactory?

Not legal under federal law. Go to a dealer in that state with the gun and seller. Dealer takes it from the seller and transfers it to you. This makes you compliant with federal law. If you want to be compliant under state law 140 sec 128B, report it on the Transaction Portal on Firearms Records Bureau website.

Has to go through an FFL for long guns. For handguns the final transfer is supposed to go through an FFL in your home state. Technically federal law indicates the sale is supposed to comply with the conditions of sale in both states. Not every out of state FFL will follow the laws of the non resident buyer's home state.

May an unlicensed person acquire a firearm under the GCA in any state?​

Generally, a person may only acquire a firearm within the person’s own state. Exceptions include the acquisition pursuant to a lawful bequest, or an over-the-counter acquisition of a rifle or shotgun from a licensee where the transaction is allowed by the purchaser’s state of residence and the licensee’s state of business. A person may borrow or rent a firearm in any state for temporary use for lawful sporting purposes.

A long arm can be transferred to you in another state.

Go with the seller to a FFL, do the transfer in his/her state

When you bring the gun to MA you need to eFA-10 it within 7 days, leave the seller info blank


NOTE: MA WILL NOT ALLOW A FFL TO TRANSFER A RIFLE OR SHOTGUN TO A NON RESIDENT
