This is frm about a month ago, so I'm not sure what has happened with it. Looks like the state legislature passed a one handgun a month law, that is awaiting the gov signature, that effectivly prevents dealers from buying more than one gun a month form anyone, except another dealer.

Wow that is flawed.

It also does not exempt certian military and security organization form the one handgun a month restriction.

If anyone knows waht happened with this, i'd be interested to know. Sorry if this is somehow a dupe.

As far as I am concerned the US has 42 states.

NY, NJ, MD, CT, RI, MA, IL, and CA are all some sort of foreign land.
 
Maryland is a default right to possess state. There are a few screwy laws but for the large part you can own whatever you wish, and no AWB either.

The only message Cunningham is sending is that he is a ignorant lying jackass. Restricting licensed gun owners to legally buying 1 handgun a month will help prevent unlicensed gun owners from getting their guns illegally. Where do these people come from really?

But you're right, Hawaii and Wisconsin make it too. That brings the total down to 40.

In any State with a controling Democrat majority, there is no place for either common sense or the Constitution.

You can have Freedom or you can have Democrats in control.
There is no middle ground.

You are partly correct. There is more to this law. I live in NJ. Not only prevents dealers from buying one gun a month from an individual. It also prevents a dealer from SELLING MORE THAN ONE GUN A MONTH TO THE PUBLIC!!!!!!!!!!!! That means he can only sell 12 guns a year out of his store. #7 below tells the whole story.

(7) A dealer shall not knowingly deliver more than one handgun to any person 1[in a calendar month] within any 30-day period1 . This limitation shall not apply to:

(a) a federal, State, or local law enforcement officer or agency purchasing handguns for use by officers in the actual performance of their law enforcement duties;

(b) a collector of handguns as curios or relics as defined in Title 18, United States Code, section 921 (a) (13) who has in his possession a valid Collector of Curios and Relics License issued by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives; or

(c) transfers of handguns between licensed retail dealers.



I spoke with a State Court judge who is an avid shooter and member of the NRA. He told me that the dealers have to bring suit against the state of NJ in Federal court and not State court. The reason is because the state courts will side with the state and the federal court will side with the dealers because this has something to do with Federal Trade Laws. So we will wait and see what happends. And YES this law was signed by CRASH CORZINE the dictator of this state last week!!!!!!!!!!!!!!!!!!!!!

So this means that all NJ retail dealers are effectively out of business until a suit is filed, fought and won ?
At the glacial pace of our court system, there won't be any dealers left in NJ once all is said and done.

OK i hate this as much as the rest of you but i do have a question.
if a dealer keeps good records, so he knows who he has sold to in the last month, can't he sell 1 firearm per month to every person who goes in there? that would not limit him to 12 a year. am i missing something?

i have purchased multiple guns at the same time on a couple occasions, so i do hate that this was passed even if i am from ma.

What is it that you don't understand? It means that if the dealer cannot sell more than 1 gun a month to ANY individual that means there are 12 months in a year and he can only sell one gun a month.

If the law was written to say he the dealer cannot deliver more than one handgun a month to the same individual is different than saying he cannot deliver more than 1 handgun to ANY individual in a 30 day period. It' all in the wording. In fact is has already been determined that if a law is open to interpretation then it is really not a law.

The way it was enacted, it lists ANY person; for a total of one person per month. Rather than stating 'limit the purchases to one per month per individual'...or as such
 
that's just asinine. I took it, at first, to mean you cant sell more than one gun to any one person in a month but you could sell 1 gun to every person who went into your store.

i see how it was written but I think they mean it the way i stated above and it will be changed, how soon, who knows. if thats not how they meant it to be, the persons responsible should be striped of office.

I would certainly add RI and Hawaii to the list but I do see your point. Its not the USA for certain anymore. We are living in a world of socialism and that is merely the beginning stages of communism.

This was also totally unnecessary and a waste of the legislatures time. If they wanted to pass a one-gun-a-month law, they already had the mechanism in place to do so without even passing any new laws. Under existing NJ law, a licensed person must obtain a new Permit To Purchase from their local PD for EVERY single gun they buy. When (if) issued, you have a certain time limit to purchase a gun, if you don't buy one before it expires, you must apply for another PTP. Your local PD knows exactly how many PTP's they've issued to you. If they rationed them out at one a month per individual, the objective of the law would have been acheived without all the other BS they've stuck themselves with now.

Fester, what percentage of towns give out CCW in RI? is the number smaller than MA? just curious.

Currently around 50% issue according to the law, another 20% have requirements that go beyond what they're allowed to have (like annual requalifications and psych exams), and the rest only issue to business owners and the politically connected.

You can apply for an AG permit, but those are usually only issued with work restrictions, or again to the politically connected. According to the law the AG is a may issue permit, and the town is shall issue.
