FALL RIVER —
A 19-year-old Fall River man has been convicted of shooting another man in the chest in broad daylight on a city street in April 2012.
On Wednesday, Dillon Silvester was sentenced by Judge Thomas Maguire to serve six to nine years in state prison following a six-day trial in Fall River Superior Court, the Bristol County District Attorney’s Office said.
Prosecutors had requested a 12- to 15-year sentence.
Jurors deliberated about four hours before convicting Silvester of assault and battery with a dangerous weapon, possession of an illegal firearm, possession of a loaded illegal firearm and possession of ammunition without an F.I.D. Card.
Bristol County District Attorney C. Samuel Sutter, in prepared remarks, took the occasion to praise his office’s “firm and unyielding policies” in prosecuting gun crimes.
“And whether it's urging courts to hold defendants charged with carrying illegal firearms on our streets be held without bail for 90 days, or urging courts to sentence defendants who have been convicted of shootings to a minimum of 10 years in state prison, or an assortment of other similar positions, these policies have changed the atmosphere throughout the county,” Sutter said.
On April 11, 2012 around 10:30 a.m., Silvester and a small group of women friends drove to the victim’s Barlow Street residence to engage in a fist fight with him and his friends, prosecutors said.
At some point after Silvester and his friends arrived at the house, the victim, 19, came outside and was confronted by Silvester, who brandished a small caliber revolver and fired one shot, striking the victim in the chest, prosecutors said.
Silvester fled the scene of the shooting, while emergency personnel rushed the victim to Rhode Island Hospital, where he eventually recovered from the shooting, despite still having the bullet lodged in his chest to this day, prosecutors said.
Silvester eluded capture for the next month before being located and apprehended in a Fall River multi-family apartment building by Fall River police detectives, prosecutors said.
Assistant District Attorneys Patrick O. Bomberg and Katie Rayburn prosecuted the case, which was investigated by the Fall River Police’s Major Crimes Division, including Detective Brett Kimball, whom Sutter praised for his “stellar work.”
