2007 Firearms Discharge Report

The 2007 Firearms Discharge Report is an examination of 56 DEA firearms discharge incidents that occurred during fiscal year (FY) 07. This report provides a statistical overview of the incidents, along with a short synopsis of each shooting. The information contained in this report is intended to educate DEA’s SA/TFO workforce and to ensure that DEA’s SAs/TFOs conduct enforcement and training operations safely and in accordance with established policies and procedures.

Incidents noted in this report consist of on-duty/off-duty shootings involving DEA SAs or TFOs, shootings by state/local law enforcement officers while assisting DEA, and shootings involving foreign law enforcement agencies with whom DEA was engaged in joint operations.

These 56 incidents involved 79 LEOs, with 10 incidents involving multiple shooters. In 7 instances, suspects either fired or pointed loaded handguns at LEOs. In 10 instances, suspects used their vehicles as weapons.

Seventy of the LEOs involved in shootings utilized some type of ballistic armor (vests, shields). In FY 07, there were no reported instances of offenders utilizing ballistic armor.

While lessons have been learned and improvements to training and operational procedures have been made as a result of analyzing these incidents, IN believes that it is vital this information be disseminated to the field as a means of enhancing agent/officer safety.

In FY 07, the number of unintentional discharges increased from FY 06 (12 in FY 07 vs 7 in FY 06). Most of these unintentional discharges occurred as LEOs were preparing to store or clean handguns, indicating a failure to exercise proper firearm safety by checking the weapon for a loaded chamber prior to disassembling the weapon for cleaning or storage. Of the 10 unintentional discharges with handguns, 8 involved Glocks, 1 involved a Colt Commander, and 1 involved a Smith & Wesson revolver.

In 10 instances, suspects used their vehicle as weapons. Most of these instances occurred during buy/bust operations where suspects were able to defeat the vehicle containment techniques utilized. This allowed suspects to escape containment and place LEOs lives in danger, thus requiring the LEO to utilize deadly force.

Average distance between LEO and Offender – 14.6 feet

Average distance between LEO and canine – 5.1 feet

Average number of rounds fired by LEO per incident – 5 rounds

Both animals retreated and the residence was secured without further incident. The animal survived its wound.

INCIDENT 56

On September 29, 2007, a SA assigned to the St. Thomas RO was entering his OGV and preparing to start the vehicle in a public parking lot when an unknown male ran up to the OGV and fired five 9mm rounds from an unknown type of handgun at the SA. The SA was not struck by any of the rounds and the suspect fled on foot. The suspect remains at large.

...the grow site during which the team become lost in the underbrush and one of the officers became exhausted and was unable to continue. Radio and cell phone communication was intermittent. The SA, in an effort to draw the attention of search teams, fired one round from her Sig Sauer P-229 .40 caliber handgun into the ground.

On October 27, 2006 SAs from the Rapid City Post of Duty (POD), assisted by local officers, executed a federal search warrant in Rapid City, SD. After entry was made and while clearing the residence, a local officer carrying a ballistic shield in his left hand and a Glock 22 .40 caliber handgun in his right, kicked open a closed laundry room door. As he kicked open the door, one round from his Glock discharged into the wall. The suspect and a child were located in the residence. No injuries occurred.

On February 23, 2007 a SA from the Yuma RO was attempting to disassemble his Glock 22 in the weapon cleaning area of the office. The SA ejected the chambered round and allowed the slide to return forward. The SA then dropped the weapon’s magazine and while pointing the weapon at a wall, pulled the trigger. The weapon discharged one round, which penetrated the wall and struck a metal door in the prisoner processing area. No injuries resulted form the discharge.

"I'm the only one in this room p'ofessional enuf..."

Sigh.

We aren't allowed to fire warning shots, etc in my department but bet your ass if I was REALLY lost, there is a real good chance I would pop off a round into the dirt to hopefully direct the search into my direction.

56 incidents, 12 of which were unintentional discharges?

And of those, 8 were Glocks. Not picking on Glocks, the ones I read all looked like basic semi-auto pistol skill issues - trigger discipline, how to clear your pistol 101, basic skill stuff. Maybe the DEA could use NEShooters services - soon. They're already a couple months into FY08....

A lot of dogs, too. Critter killer calibers would seem to be a priority.

When I go off into the woods, I carry a whistle. And a compass (two, actually). And a topo map.

DEA probably issues Glocks, so any incidents that occur will be with Glocks.

INCIDENT 25

On April 4, 2007 SAs from the Seattle Office, assisted by a local Sheriff’s SWAT team, executed a state search warrant at a residence in Shoreline, WA. As one officer attempted to clear a closet, he switched his Glock 22 from his strong to weak hand and attempted to activate the light attachment on the weapon. The officer unintentionally pulled the trigger, discharging one round into the wall. No injuries resulted from the discharge.

mmm, so where people like this fined/cited for negligent discharge of a firearm?

The incidents described are of two very different classes: 1) negligent discharges, and 2) gunfights. If the average numbers of rounds fired per incident includes the negligent discharge events, that will make the average round count misleading.

What is interesting is not the average number of rounds fired in all incidents, but the average number of rounds fired in gunfights. The average number of rounds fired in an accidental discharge is probably very, very close to 1.

Not adding it all up, but just perusing the numbers, the round counts are still low in all intentional discharges. As they should be. Most of the time here gun fight is not the right term. There is a gun and a charging animal. The public would never think that the DEA has more "gunfights" with animals than BGs but apparently from this that is the case. It seems BGs with dogs are more dangerous than BGs with guns. Time to ban dogs.

This is some good shooting...

INCIDENT 48

On September 10, 2007 SAs/TFOs from the Riverside DO were assisting San Bernardino and Riverside County Sheriff’s Deputies conduct a marijuana eradication in the San Bernardino National Forest. As the deputies approached a large marijuana grow site, two suspects opened fire on the team. One suspect fired four rounds at deputies from a shotgun. Deputies returned fire, striking and killing the suspect. As deputies were securing the scene, a second suspect fired two rounds at deputies from a high powered rifle and fled the area. No law enforcement personnel were injured. One San Bernardino deputy fired 12 9mm rounds from his Glock 17; a second San Bernardino deputy fired 2 rounds from his Glock 21 .45 caliber; a third San Bernardino deputy fired 4 rounds from his Glock 17; and a Riverside Deputy fire 2 rounds from his Smith & Wesson handgun. .

Distance of shooting: 50 feet

This is some good shooting...

Took the words right out of my fingers.
There were too many incidents where the BG was engaged within 15 feet, some as close a 3 feet, and the officers missed.
BTW, the incident where more than 200 rounds were fired skews the round count per incident average just a little bit.

Excusing the death of the last animal, for some reason I found this hilarious.

On May 3, 2007, SAs from the Knoxville RO were assisted by local officers in executing a search warrant at a residence in Knoxville, TN. As SAs and officers attempted to secure the residence, four pit bulls charged the entry team. A fire extinguisher was used to fender off the animals and three fled. A fourth continued to charge and was shot four times by an officer with a Mossberg shotgun using 00 buck. The animal expired at the scene.

Distance of Shooting: 3 feet

You would be amazed at how well a fire extinguisher will stop an angry dog. They usually defecate all over the floor before they turn tail and run. Besides, it's safer than letting a round go in a multi family residence or any residence. It is also good to have if you start someting on fire with the flash bang.

We frequently bring a fire extinguisher along on search warrants involving dogs. They work quite well.

Incident 37 will be the talk of that trailer park for years to come. That must've been a sight to see.

And let me tell you, I think the worst kind of AD/ND has to be just after cleaning your gun, as many of these agents found out. You just did all that hard work, and then you have to do it all over again. Sheesh.

But a good read all in all.

A lot of absolutely inexcusable NDs (e.g., remove the magazine and pull the trigger without checking the chamber, moving around with a finger on the trigger and no possible target even in sight, etc.), and a discouraging number of incidents from my old stomping grounds (and my mother's and brothers' current home), San Bernardino.

Jim, have you got a cite for this so that we can read it off-line and refer others to it?

Ken
