Woburn LTC - Survey

Is this language "a good reason to test" in either Ch140 or 131. I printed out the new law last year and will check when I get home but I do not remember this wording? This is from the instructions from the City of Woburn on applying for LTC.

my LTC in Woburn is set to expire in 2018 but the chief revoked it based on sutibility because he found out I had PTSD vet . never been in trouble. my hearing was scheduled to be today but the chief moved it cause now he wants a attorney. Any help or a good lawyer. I didn't commit anything illegal it was pulled for ptsd.had a ltc before and after the army. it was found out when I got my break on my property tax

You need an attorney ASAP (Also, contact Comm2A).

You may (emphasis may) want to drop the district court appeal and file in federal court. An adverse ruling in marsupial court may make it harder to initiate a federal case on a "decided issue", or the federal court may decide abstention applies and you would need to bring any appeal in state court.

If you go federal, there is a smaller chance the case will start out with the chief and judge greeting each other by first name and asking about each other's kids. Also, by going federal, you could make this an ADA (Americans with Disabilities Act) case, plus, if you win, you get your legal fees paid (42 USC 1983). Of, if Comm2A takes an interest, Comm2A gets its fees back.

Also, have you arranged for expert testimony or an affidavit from a treating MD that there is no medical reason why you should not be denied a gun license? Without this, your chances of refuting the chief's conclusion go way down. Remember, in state court it's "ordinary citizen vs. dedicated and skilled public safety professional".

Most importantly, don't roll the dice in district court without at least consulting with a firearms specialist attorney about the merits of federal vs state court action.

I got unrestricted on initial application but had a letter from business owner that I did cash deposits at random times. On the renewal the office woman asked who issued me the unrestricted license and was shocked to hear it was Woburn. No downgrade here though.

I thought this warrants a restriction of work use only. Aka you can only carry when working.
 
Contacted Comm2A great organization They gave me a lawyer whos working on this case. Turns out the chief is in the wrong .
 
After over a year and the help from Comm 2a my license was reissued but with a target restriction. I'm just happy to have it back
 
I guess we can move Woburn to the red column now. Good luck! Hopefully Jason and comm2a will go to bat for you and kick that chief in the breadbasket.

They've always been in the Red column, IMHO. No "moving" required.

Has anyone attempted to file a petition for judicial review due to their restrictions? Or does that bring us back to the chief and judge talking about their kids since it's district court?
