Transmitting data you dont want transmitted is the easiest thing to detect. Every security researcher on the planet trying to make a name for themselves would find this out in 5 minutes. Bottom line, this is not happening, if it does it gets exposed very quickly.

With the stuff that iOS and Android are baking in to the OS... we'll have to wait to see if there is anything baked in that would allow tracing to be done with the phone "off", since "off" may or may not mean everything is powered down.
