Injunctions to stay enforcement pending appeal are to avoid "irreparable harm" in the even the appeal succeeds. The court decided that the "irreparable harm" of allowing continued possession while the appeal was underway was more significant that the "irreparable harm" of forcing subjects to disgorge themselves of, or irreparably damage, personal property.
