Carrying, but forgot to carry LTC

We just look it up in CJIS. Its simple and needs to be done to confirm an LTC is still valid anyway, and send you on your merry way. Not a big deal. Of course like town to town and person to person, every department and officer is different.

And the statute provides a great deal of discretion. It is what it is...

Here's a funny story that happened to my 58 year old brother last year. He left Ashburnham for a nice bike ride and ended up at the edge of the Gardner state prison off Rte.140 after traveling down a dirt road. He didn't know the prison was just ahead and when he came to a clearing he was facing a wall with barbed wire. He said to himself WOW the state prison. He turned and noticed a group of prison guard talking and pointing at him. They ordered him not to move and they all approached him. They start asking him what he's doing here and if he's taking pictures. He was getting a drink from his water bottle. One of the guard asked what he had in that saddle bag behind the seat. He told them he had a handgun in there but was licensed to carry. When he went for the license it wasn't there. Yep, he forgot the license at home. One of the gurard radioed in that an intruder with a handgun was there. Well the guards that were there weren't carrying any weapons so they radioed for help and that produced a group of now armed guards. Once again he was asked what he was doing riding up to the prison. They were afraid he might of thown a weapon into the prison grounds. Anyway the Gardner police were called and when the officer arrived he wasn't very happy with my brother. Told him he was going to report this to the Ashburnham police and probably would revoke his license. The officer escorted him out the front gate and told him if he wanted his gun back he would have to pick it up at the Gardner police station. After pedaling home he got the license and shot to Gardner. Met the chief there who was very nice to him, not like the officer he met at the prison. The chief told him he didn't do anything wrong but show up at the prison uninvited and without his license. Gave him back the gun and told him he wasn't going to notify the Ashburnham police about this. He will never forget his license again. The prison had no warning signs stating the prison was just ahead and to stay out. Those prison guards had to search his route to the prison for hours making sure he didn't drop off any weapons anywhere.

When i was active LE, I was visiting a friend at MGH and just before the rotating doors at the main busy sidewalk entrance,..with a gazillion people walking in and out, my belt buckle broke, belt loosened up and my concealed sig 229 still in the holster dropped on the ground in front of many people, some of which just froze in place staring at it. After the initial "oh shit" reaction I promptly reach for my badge, turned it around in a full circle for people to see, and said "it's ok folks, broken holster" as o picked up my gun. everyone kept walking and didn't blink an eye. Whew!

If the area was unmarked, and I had my LTC with me, I'd have probably become belligerent. They are not police officers. They do not have any arrest powers that you don't have. It is effectively, kidnapping if they try to restrict your free movement.

If the area where he was was not posted, then he was lawfully exercising his right to free movement.

On a practical note. I'm surprised its set up like this. The prisons have pretty large buffer areas around the fence that are VERY heavily marked with NO Trespassing signs. You cold never accidentally find yourself anywhere near a prison wall/fence.

Thats a funny story. The sad thing is that if it happened to one of "us", we'd have our LTC revoked. It sounds like I should get one of these. I'm guessing nobody actually read your badge. They were still looking at the gun.

"Agent Fleming: Agent Hurly, I want you to give this scumbag a cavity search. I'm talking Roto-Rooter. Don't stop until you reach the back of his teeth."

I'm sure noody actually looked at what the badge was, coulda said "captain Kangaroo" for all anybody ever knew.

This fits what I was told (don't recall who, it was probably 30 years ago). Basically if you have possession of a gun and don't have the LTC/FID ON YOUR PERSON (or within arm's reach), it is treated as if you aren't licensed at all!
What if?? You are held up for your wallet. Seeing as here in suckachusettes it is frowned upon to defend your property, you hand it over. Now cops are called and you are carrying??

I recently took a class that required I provide proof of no-scumbag (good thing they didn't ask any females that know me), so I scanned and emailed my MA LTC, and for good measure, my NH, ME, and Utah non res. Of course I spaced and went two weeks of EDC, plus a drive through NH and ME to attend the class without any of said licenses on my person. Nearly had a heart attack when I looked in my wallet and they were not in there. I do the cell phone trick as a back up with the hopes that I will have my face shoved in the grass instead of the pavement. As someone else posted, would rather have the SIG than the LTC. As for condoms; "I never use 'em" R. Balboa

I never go anywhere without my LTC, carrying or not. I never know when I will run into a firearm or box of ammo I might want to buy.

Ya it's up to you to produce your ltc a cop in mass and can demand it and you have to show it. If you don't than according to a police officer you don't have one

Same, mine is in my wallet unless I'm buying something, also do a mental check list anytime I go anywhere , keys, phone, wallet, pager, pen, knife...ok good to go

In that case you get arrested! After all you can't even prove who you are, never mind no LTC!

This is MA after all!

We road-tripped this past week to the south. A hundred miles down the road I realized I left all my non-MA licenses at home. Frantically checked the reciprocity sites and saw that TN and NC recognize MA, and that was where we spent most of our time. NY, NJ and MD are lock-it-up-and-don't-stop-for-anything places anyway, so my only problem was VA, where we did spend some time. Did some reading and found out that in VA, if you have a valid permit but don't have it with you, it's only a $25 fine. I took the risk. [wink]

I did something like that once. I went back home and found them still on the glass of my MFP that I scanned them on a couple of weeks earlier. OOPs.

For what its worth, I write my Pistol Permit number on the mag that is in my carry pistol. Its not perfect, but it never hurts.

Dude, you've reached step 3: Profit!

On your advice, I spent the morning at the US Patent office trying to get this thing patented. I was waving it around to show everyone, yelling "NOW PEOPLE WILL TAKE ME SERIOUSLY" because I was so sure I was about to strike it rich, but for some reason I couldn't get anyone to help me. Someone must have called in a bomb threat or something because pretty soon the whole building was surrounded by cops - I had to slip out a back door just to avoid all the confusion.
