Boston police officer sues online market where gun used on him was sold

This would be like suing ebay because the buyer then sold the car to someone else who killed someone by DUI

Suing FaceBork because someone hurt your feewings. Suing Google because you searched for something and the information is wrong. Although I'd like both of them sued just on principal. ;)

Great ad placement on that one!!

“This is not an anti-gun case. Certainly officer Stokinger is not an anti-gun person in any way,” said Jonathan Lowy, an attorney with the Brady Center.

Aside from his voluntarily becoming one of the (very anti-gun) Brady Bunch, of course.

One cannot have it both ways, Mr. Stokinger.

Finally got a decision dismissing Stokinger's case on communication decency act grounds. This is the second case brought by the Brady bunch that has been dismissed on CDA grounds.
Good, but these need to start getting dismissed "with prejudice", and the plaintiffs counter-sued. The Brady Bunch's pockets are not limitless when they start losing harassment lawsuits, and they'll have a hard time finding willing partners when the co-plaintiffs start seeing the possibility of getting hit with counter-suits and damages.

On the other hand, Eric Goldman, director of the High Tech Law Institute at Santa Clara
University School of Law in California, said he was surprised the plaintiffs chose to pull
Armslist into the lawsuit in the first place, since §230 jurisprudence is so clearly established.

“Anyone tackling an immunized defendant needs a really smart game plan as to how to get
around it,” Goldman said. “If they don’t, they’re wasting their time.”

Good to see the "because gunz" legal theory beat again - congratulations!

@nstassel what is stopping recovery of defendants legal fees and or sanctioning the plaintiffs attorneys for filing a frivolous lawsuit?

It's being discussed. Brady Center is behind all these suits. They believe, incorrectly, that each state should be able to interpret for itself the CDA and accordingly each suit is not frivolous. Obviously we disagree and they are simply trying to litigate Armslist to death.
