This is very likely a case of "allowed because it's not specifically prohibited." Some LE agencies have policies that allow or even require officers to be armed while intoxicated. It's legal in MA if the cop doesn't have an LTC (carrying "on the badge"). In most cases it's an invitation to trouble. In my state intoxicated carry is legal, just not in a bar.
