There is some bullshit out there with "Constructive possession," where if you have a lower sitting around alone, and an upper with evil shit on it, they can get you on it since you can make it illegal.
True. Supposedly if you also possess a genuine pre-ban this would not be an issue (at least this was the case per BATFE back during the Fed Ban).

To my understanding of the statutes and regulations, Dench is completely correct.

No one completely understands all of the nuances (a subtle difference in meaning) of Massachusetts and Federal Laws. Some are actually contradictory. The interpretation of these "laws" depends on facts, specific terms and situations which cannot always be determined in advance.

When we are asked questions in the shop we give our opinions as much as the facts since there is so much room for interpretation.

Fattman, the comment about "BS" given by any individual is improper and somewhat insulting. Especially since it appears to be completely correct.

When somebody IN A GUN SHOP - says that nobody should have a gun until they are 21 - they proper course of action is to say - LOUDLY - that the person is an a**h*** - because apparently what they believe is that it's perfectly OK to draft 18 year olds into military service (or get them to sign up voluntarily) - arm them with rifles - have them go kill people (and get killed themselves) - but it's not ok to let anybody under 21 OVER HERE - actually be able to defend themselves.
Actually, it would be more like drafting them at 18 and sending them into battle unarmed.

Where in the constitution is the Federal Government enumerated the power to decide at what age you can exercise a constitutionally protected right.

I'll save you the trouble of looking it up, it isn't....

Just sayin.... When I grew up I handled firearms when my parents decided I was ready.. Not when some bureaucrat in a far distant capitol decided he could raise me better than my parents could.

I did my safety course and I've purchased both my firearms from Flint. Kaisha lead the class and she was awesome. Arthur sold me my first pistol and Jamie sold me my second....both were great to deal with.

Misunderstandings happen. Good on the owner for chiming in.

Even if he said exactly what he is being accused of, do you suggest that he does not have a (1st Amendment) right to his opinion. Why does it have to come to bashing the individual and now his employer? Should he be lynched?

With that as a background, it seems that you are admitting you would not have an issue if your employee did speak out as the OP alleges. That sir amounts to a serious slap in the face to many here.

A more acceptable response would be as follows:

"I have spoken to the employee in question and others in the shop that day. It seems, to me, that my employee was very unclear about what he was saying in order to cause such a disturbance. Measures have been taken to insure that employee/customer communications are as clear as possible in the future. If you would like to discuss this or any other concern, please feel free to drop by the shop."

No admission of guilt or backpedaling - everyone happy plus retention of customers

i heard about the incident from people who were there (who i trust) and i believe this post. it does appear that things were taken out of context and there was a misunderstanding.
He had me right up until he hinted that freedom of speech includes freedom from consequences.

I’ve known roger for some time now and he’s has always been very nice. As for the "tall skinny kid" ive known him for a while and im sure he was just speaking from his own personal experiences.
I ask questions all the time and if I hear something I dont like, I just tune them out and move along. I see people come into the shop all of the time with the "holier than thou" (Exhibiting an attitude of superior virtue for, thoes that wanted that in english) and a "know it all" attitude and treat the folks at Flints like crap.

Just remember people, the attitude you get from others is the same one you give.

I certainly hope this wouldnt be saying I would be some type of know it all or have that attitude..... I bit my tongue multiple times.... In the course of 5 minutes of conversation while filling out paper work I hear.... There are no crossbows hitting 500 fps.. youtube and the xbow and a few other manufactures would have a lot to say about that... I simply said oh i must have misunderstood the person i was speaking with.... I was then told there was only one bow over 400 fps..... a simple web search will show thats far from true.. I simply agreed... There was a fella speaking of a nutered licence. From fall river.. Was told he was to young... I told him his best bet was to move...I was then told Dartmouth was no longer a green town... Theres a thread that def. shows that the issues is staffing.. I dont know anyone with a restricted ltc in dartmouth.. I did open my mouth i know the lic. officer in dartmouth and the 2nd one they have trained... So saying they are not pro2a yes would piss me off.... This conversation was while i was filling out paperwork.... Then said employee agreed that the fallriver police chief was right not to let a 21 year old have a ltc.... Sighting the fact that when he was 21 he could not be trusted with a ltc... I said a hell of a lot of guys in Afghanistan would feel different.. You should get it at 18... I spent the last ten years of my life in sales and making darn good money doing it.... You dont do that buy " misunderstanding"a entire conversation.... So if basically holding my tongue multiple times.. Until someone insults 2 friends and then says at 21 years old people shouldent have a gun makes me a know it all... im sorry.... And again i was basically saying again well ok he said it was a misunderstanding... I will agree and keep my mouth shut... then i get called some type of know it all..... and yup I ope my mouth again.....

Staff commentary aside, I've purchased a few firearms, ammunition, kit for my chest rig, and holsters from Flint. I recently used their gunsmith when the smith I usually use didn't want the work. He did a great job and turned it around in a day. They've done good by me and I appreciate another shop spreading firearm goodness in this god-forsaken, socialist hellhole.

From my perspective, this whole thread is FAIL. There are plenty of commie bastards in MA to bash without beating on one of our own.

At Flint Armament, we strive to do right by the shooting public...
So if on your time and on your dime your employee tells a customer to go to another gun shop because it is better that is okay because he is expressing his first amendment right.

You have a corporate image to uphold and that is just about the lamest statement I've ever heard from any business owner or retailer. It's like employing a vegetarian in a butcher shop.

I want a job with your outfit where I can say anything I want on company time.

From my perspective what you are saying is that you can be a lib yard moonbat anti-2A person, work for Flint, articulate your position whilst (literary enough for you?) on duty and spew whatever crap you want because it is your first amendment right according to the owner.

We wonder why we are failing?

So whatever happened to free expression? If you don't like his ideas present your own. Someone once said (Justice Brandeis perhaps?) the best disinfectant is sunlight. In other words, ideas should be countered with ideas.
You have NO FREEDOM OF EXPRESSION when acting as an agent of your employer. You say and do what you are told to or you leave.

If the shop endorses the expression by not correcting it once they know, then he can say what he wants and either way the public is free to react as they choose.

His name is Chief of Police Paul Keenan. He's decided, as the licensing authority, that only those over 25 deserve the right to defend themselves.
I believe that is Captain Anthony DiBona and not Keenan that came up with that. He was quoted saying such a thing about age and LTC in an article I remember reading.

However of course I may be wrong it could be the other way around or both of them! [hmmm]

It's terrible to hear about what happened at that shop and no person should be treated like that. I stress the point of "person" rather than "customer" because we people first. The response from NES members have been incredibly encouraging and with all the calls and emails we can't wait to have the doors open. We do appreciate your patience and have plenty of product available. Most importantly at this time we are open for the NRA/Mass firearms certificate classes in our conference room in our main facility. We have scheduled openings every Saturday with class sizes of 4-8 people. We could host more per class though we believe the best learning happens in small group environments. If you need another weeknight or day we'll do our best to accommodate. Lastly the price is $75 per person. We genuinely want to serve you all with your firearms needs as well as the training to get you started. I was living there when Keenan became COP and had a few windows into what was going on at the time. I don't know for a fact who originally thought up the idea, but Keenan was very much making the final decisions on policies like this.

Pigs and sheep, in the Orwellian sense, on more than the 25 year old limit.
