NH House in session, rights at risk…

Well, this week the New Hampshire General Court will begin the 2019-2020 session and it looks like their first order of business is to blatantly violate the Constitutions that they took an oath to uphold by passing rules and legislation that will strip you of your Constitutional rights. I guess those guys were correct in their quotes.

Wednesday morning, January 2, at 10:00am The New Hampshire House will convene to begin the session and, according the House calendar, they intend to vote on the following: Amend House Rule 63 to read as follows:

“63. Deadly weapons; electronic devices; cameras. No person, including members of the House, except law enforcement officers while actively engaged in carrying out their duties as such, shall carry or have in possession any deadly weapon as defined in RSA 625:11, V while in the House Chamber, anterooms, cloakrooms, or House gallery. Any person in violation of this rule shall be subject to ejection from any such premises on the order of the Speaker and disciplinary action or arrest or both by action of the House. Nothing in this rule shall indicate that the security officer appointed by the House under Rule 61 has the right to stop and search a member of the House on the premises of the House. With the exception of devices for the hearing impaired, no member shall operate audible electronic transmitting and/or receiving devices nor shall any member operate a video camera or a camera utilizing flash bulbs on the floor of the House, while the House is in session.”

This will impact every citizen that shows up to watch a house session, this will also impact every hearing that is held in Reps Hall, and for the record, most hearings on Gun related legislation are held in Reps hall. This will also pave the way for a state house complex gun ban, something the new anti-gun majority tried the last time they were in control of the House. In 2008, they attempted to pass HB1354 but the bill was soundly defeated, so they went through a back door and banned guns via a vote from a House Committee.

Here is what I need you to do.

1. Contact your State Representative and ask them to oppose rule 63. Click here for contact information for all State Representatives.

2. Take time off of work on Wednesday morning and show up to the state house and join us in the Gallery to watch what is going on. We will meet at 9am on the third floor to make sure that we have seats in the gallery to keep an eye on what shenanigans are going on by our elected officials. I suggest that you show up between 8 and 8:30am as this is the time to meet the members on the way into the state house. It is also easier to find packing earlier in the morning.

3. Forward this alert to your gun owning friends and family members and ask them to do the same. Remember to be polite but firm when speaking with State Representatives. It is critical that we do not let this rule take effect without a strong response. Unless there is a strong, pro-gun response, our enemies will be emboldened to work harder to pass even more restrictive laws. Lastly, just to show how much they want to go after our gun rights, the FIRST bill of the session, HB101, is a bill to allow local school boards to strip you of your right to carry, regardless of if it is their property or not. This is a replay of the Hennessey Gun and Self Defense Ban from last February.

I really wish I could do more. Problem is, I'm still a resident of the Constipation State. Anything I say or do as regards New Hampshire will be as Carpetbagger Extraordinaire. Shit, I've already been told that I had better be up there and ACTIVELY participating in community affairs for a period of several years before inserting myself into local matters (something I happen to agree with wholeheartedly).

While I agree with your concerns, re: carpet bagging; it sure didn’t make any difference to Molly Kelly and her supporters. Fire with fire, my friend...

Nor did it make a difference to Anti-Gun Carpet Bagger Maura Sullivan. She was an IL transplant that tried to buy our congressional seat with money from out of state....

Hopefully I will be there too... I just found out about this yesterday. I need to call my boss first thing in the morning and see if I can take the morning off. Hopefully he’ll let me. He’s usually pretty good about it but we are incredibly busy right now and coming off a four day weekend, he may get squishy when I ask.

JR, do you have a best guess when this will be over tomorrow? I’m sure my boss will ask when he can expect me if he gives me the ok...

BTW, can we heckle from the gallery? j/k (sort of). It should sound like the British House of Commons in there whenever they are in session...no more of this forum and decorum.

Well I made it here, late but here before the season started.

Unbelievable...OK for me, not for thee. This is not the NH I grew up in and love.

I wonder if they arrived and made it past staff with their jackets on and the signs weren't seen. I would raise a stink with the authorities.

Staff confiscated signs at the gallery entrance. Going after 1A already, 2A isn't enough for them.

I would've made them show you the RSA where you can't have signs...I've seen them many times when in the gallery and on the floor. We need to start making a stink about stuff like this, be as obnoxious as they are.
 
They are saying lock boxes will be available, but is that just reps or will they be available for the little people.
If this passes we should test this.
 
So they're going to have 400-500 lock boxes for folks that attend hearing?

There are two buildings they need to accommodate.....so they are going to duplicate this?

I'm pretty sure they will be pushing a bill to ban from the entire building, and there was mention of a bill to put in metal detectors, I'm sure those won't be for them, just the little people.

Well, that was expected... So they voted in the rule. Ley even compared the situation to an airport (which it clearly isn't and that kind of invasive search just to go to a legislative process would be seriously offensive to liberty).

The vote was largely along party lines, although four Democrats voted with the Republicans against the ban: Thomas Buco of Conway, Mark King of Nashua, Peter Leishman of Peterborough and Barbara Shaw of Manchester.

One Republican, retired judge Edward Gordon of Bristol, voted with the Democrats.

Thank those Dems even if they don't see eye to eye with you on other issues. They at least understood this one. And the retired judge should be ashamed. This is the General Court, not the Judge's Court.
 
After, as I thought about what was said, I realised there was much said about the Rep not being able to carry, but nothing about how this would affect the people in the gallery. The NH costitution says
[Art.] 2-a. [The Bearing of Arms.] All persons have the right to keep and bear arms in defense of themselves, their families, their property and the state.

So the RULE, not a law, strips us of our right, and does so without anything resembling due process.

I wish I had the money to challenge this as a violation of out NH Constitutional Rights, I'd start with getting a Judge's injunction preventing enforcement until it can be properly heard. The House does not have unlimited power in their rule making, they can not violate your individual rights.

I agree...there has to be someone out there that would take this on, if not pro bono, at least close to it. Any pro 2a lawyers on this board that lives in NH?
 
It was Winston Churchill that first said: "Never let a good crisis go to waste".
In this case, the majority of the legislators needed to create a problem so they can further trample the Constitutions as well as our rights.

Good summary, and I hope your constituents appreciate it. This part jumped out:

Amendment to Rule 63 (as amended earlier), requiring a Protective Services escort upon request for any member leaving the State House, to the place where they have parked. I voted Yes; the amendment failed on a division vote 154-221.

They want conservatives to live in fear before and after doing the people's business.
