Update on GOAL’s Federal Court Action on License Delays

As our members know, Gun Owners’ Action League (GOAL) has been working to address the needless delays in processing firearm license applications by many cities and towns. Citing COVID as an excuse, a number of municipalities have ceased processing all together. Others may be processing them, but at a greatly exaggerated delay.

Our first case against the City of Lowell was unsuccessful. This was mainly caused by the city processing the application from the one plaintiff. As it turns out, they issued a restricted license that is now being challenged by the license holder.

The latest federal court action has begun by going after twelve different towns. They are: Stoughton, Weymouth, Brockton, Warwick, Cambridge, Hingham, Lunenburg,

Boston, Berkley, Chelsea, Danvers, and Paxton. This list may grow as the case moves on. The lawsuit specifically alleges that each defendant (city/town) has adopted a policy, custom or practice of suspending the processing of firearms license applications during the COVID-19 State of Emergency.

GOAL had been previously working on the case with Comm2A. We are also happy to inform our members that the Second Amendment Foundation (SAF) has agreed to essentially take over the case. SAF has far more experience in the federal court system than GOAL and we are happy to have them on board. The NRA has also offered to financially support the effort if needed.

We also want to add that we understand the frustration of our supporters as to how long this process takes. As we often have to remind folks that bad things happen very quickly, but it can seem an eternity to make good things happen. Thank you all for your support and your patience.

I'm still solidly in the park that if licenses aren't a "infringe[ment] on a right protected by the Second Amendment" (Chardin v Police) but you can't get a license because "covid", and have no other avenues to lawfully obtain said license (MSP) and therefore can't exercise that right, then indeed, licensing is an infringement as it serves to undermine and limit your ability to exercise your rights.

This is chess not checkers, you have to see the bigger boobs picture at the national level. Sometimes you gotta let the little fish get away so some of our bigger and more elaborate swinger parties lawsuits can get traction and really change the landscape"
