Update: .223 rifle or 7.62mm rifle? (SAIGA)

I talked to my buddy today, he either finally stopped into the dealer or called him. Said dealer, says that a Saiga does not fall under the classification of an Assault Rifle, but instead falls under the classification of a sport rifle and therefore can be sold with the telescoping stock, but he did say it was a grey area.....?????

The term `semiautomatic assault weapon' means--
...
(B) a semiautomatic rifle that has an ability to accept a detachable magazine and has at least 2 of--

`(i) a folding or telescoping stock;

`(ii) a pistol grip that protrudes conspicuously beneath the action of the weapon;

`(iii) a bayonet mount;

`(iv) a flash suppressor or threaded barrel designed to accommodate a flash suppressor; and

`(v) a grenade launcher;
 
I still think it falls under the classification of an assault rifle guided by the rules listed above but i just thought i would share with everyone else.


So what defines a sport rifle?
 
the sporting purpose test applies to rifles which can be imported. The AWB provisions against sales and ownership are a separate issue.
