    The disconnect for me WRT to RP is that since he has been in office President Obama issued 10 emergency declarations, and President Trump has issued 3 prior ones, none of which he apparently objected to. His objection in this case appears to me to be as much about his tepidity for a border wall in general, as evidenced by his vacillation on this issue (ex. No then Yes - HuffPo 2010, No - CNN Jan 2018, No - FTN Dec 2018, Sorta - WKMS Jan 2019), than the means of funding.

    The law says he can do it. It's not in the least ambiguous , black and white.

    Rand Paul was no friend of Obama. He routinely opposed a lot of the BS over steps the BO administration tried or implemented.

    The guy has been consistent pretty much throughout the entirety of his career as a senator. He wants to drastically slash taxes, government spending, entitlement programs, the size of government and is a huge (no exception) supporter of 2A.

    His actions on this particular issue shouldn’t surprise anyone.

    Not a single one of Obama’s nor any of Trumps except for the last one misappropriated taxpayer money in order to pay for a program or build something not authorized by Congress.

    Funny how Obama gave $150b to the Iranians, which was never appropriated by congress, nor an emergency declared, and nobody even squawked much about it. For that money we could have built a wall on the Canadian border too.

    The cash ($1.7b) came from the State Department budget, they have a "miscellaneous" fund, which was appropriated by congress, but not specifically earmarked for anything in particular. This is the same fund that had $6b mysteriously disappear while HC was in charge, and nobody knows where it went. Funny how congress didn't make any fuss over that money being misappropriated

    Why the hell pay them the friggin' interest anyway, on frozen assets ???
    The US gov seized it as forfeiture from the regime that overthrew the Shah and held our hostages.
    I remember the deal, the Shah gave us $338m for a military aircraft order, which weren't delivered because he was deposed in 1979. They shouldn't have gotten any of it back, and certainly no more than the original $338m. Also, the math tells me that $338m, at 5% compound interest for 36 years, only comes out to just under $2b. So where did the other $148 billion come from ??? (Hint: look in the mirror)

    That's the purpose of the National Emergency Act. It gives the president authorization to divert funds from other programs. In this case, Trump is proposing to divert $3.6B from military construction, $2.5B from DOD's drug intervention activities, and $600M from the Treasury's forfeiture funds, so he's not exactly "misappropriating" taxpayer money, yet.

    In addition, 2 US Codes allow for the diversion of funds, one of which is U.S. Code § 2293 "which allows the Secretary of the Army in a national emergency to “apply the resources of the Department of the Army’s civil works program … [to] the construction, operation, maintenance, and repair of authorized civil works, military construction, and civil defense projects that are essential to the national defense.”

    Of course, groups within the US, that for the most part, hate the US, are filing lawsuits to prevent this, but until the lawsuits are resolved, it's premature to state that Trump misappropriated taxpayer money. Where he might lose with some of the lawsuits is where private land is being taken to build the wall. Even then though, national security may supersede these lawsuits.

    Sounds like we need military work camp detention centers along the borders. The word "WORK" will be enough to keep them from trying to cross the new wall. This should be real work, and not a summer camp. Give them the same third world services they're used to and we are starting to get.

    We had to suck it up when Obungle was doing stuff we didn't like because the law said he could, but it's suddenly different when Trump does it .
    It's the same set of rules that were there 3 years ago.

    I'm actually starting to wonder if we're doing the right thing, building this wall.

    We have bigger problems to solve. Like disposing of all the nuclear waste from our reactors.

    How about we dig a whole bunch of holes along the border using well digging equipment and we pour in the nuclear waste.

    If anybody DOES make it across the border they won't be able to have any more kids and chances are they'll croak pretty soon anyway.

    Plus we get rid of all the waste we're just paying to store.

    Win win.

    The national emergencies act was passed specifically to limit what the President can do since the COTUS is silent on these types of powers.

    This legislation does not grant the POTUS emergency powers, those powers already existed. The fact that Congress passed a law to limit these powers demonstrates that.

    These powers have been used ~ 50 times since the legislation passed in 1976. Not once was a peep from Congress or the media heard.

    I believe that DACA was issued under this but I could be wrong.

    The bottom line is that it is up to the Executive branch to enforce existing immigration law. So Trump is using his emergency powers granted by the COTUS and limited by the National Emergencies Act of 1976 to carry out his statutory duties to enforce existing immigration law.

    The way I understand, congress wants 20 years of Trumps taxes. Statute of Limitations 3yrs personal & 7 yrs business iirc,

    Would it be okay if Trump utilized the Lois Lerner/IRS method of data retention? Computer crashes, drives degaussed/shredded?
