I bought a "new" used truck.

A delivery boy pulled into my driveway to turn around, and smashed it.

There were multiple witnesses.

It's been 3 months and I have zero dollars.

Stonewalling from insurance companies.

If I go through my insurance, my premium will go up by over 2X for at least 6 years, and I will have to pay the deductible - I've got a 100% clean driving record currently. If I go through his insurance, it won't hit my premiums - they scoffed and offered me less than 1/4 of the body shop estimate, and have spent a month NOT sending out their own inspector.

Nobody seems to understand that my car was parked on my property and that I was asleep; they keep saying that I was "involved in an accident" and I will "have an accident on my record". I was not driving, my car was not on the road. It was legally parked in my driveway when a trespasser destroyed it. As far as I'm concerned this is basically a case of vandalism...

Screw the insurance system. Glad to know the judicial system is equally useless.
Yes. You understand.

You don’t actually have car insurance. The insurance company will advance you the money for damages and then recoup said money for the next 6 years.

There is a reason that the tallest buildings in most cities are named and built by insurance companies.

Hancock and prudential. For just one example.

Who the hell is your insurance company that they aren't on your side on this. This is one of the reasons I use an agent for all my insurance needs. They will go to bat for me, and have in the past when my son wrecked my motorcycle. The insurance company was going with the BS that he was my son but I didn't list him as a driver, but he doesn't live with me so that requirement doesn't apply, he's just some dweeb I loaned the bike to. My agent dealt with the two insurance companies involved and got it all settled, I didn't have to lift a finger.
Fyi, with the advent of pornhub, your agent is shafting you by billing you double what you should be paying and giving you lip service about going to bat for you and rubbing one out in the back office every couple of hours while he visualizes the f***ing he is giving you.

Wow. My jaw has actually hit the deck. I have never heard of this.

My post from two years ago... yeah, that one, holy crap was I wrong.

Well done. But then 500 bucks ain’t what it used to be 2 years ago.

So here's what happened (I just checked the docket)

He was charged with witness intimidation (a felony), Vandalizing property (a felony) and threatening to commit a crime

On 11/27/17, he pleaded guilty and asked for probation and $1000 in restitution. The DA asked for six months in jail. The judge agreed with the defendant capped plea, but determined that he didn't have the "present ability" to pay $1000 in restitution, but did have the ability to pay $500 in restitution. He was given until 2/28/18 to pay the restitution

On December 20, he was handed a notice of a probation violation. It seems he was arrested for driving with a suspended license.

On January 31, 2018, his probation violation hearing was continued
On 3/8 his VP hearing was continued
On 4/24 he defaulted and a warrant issued
On 4/25 he showed up and removed the warrant
On 5/30 he was found in violation of probation, placed back on probation, and given until 11/27 to pay the restitution
On 12/12 he was given another VP notice
On 1/23/19 the VP hearing was continuned
On 2/27 he defaulted and a warrant issued.
On 3/2 (Saturday) he posted a $500 bail (not listed on the docket, but one can safely assume he was arrested on the warrant and the bail clerk saw the $500 restitution amount and wisely set the bail in that amount)
On 3/4 (Monday) his VP hearing was continued.
On 3/27/19 the judge terminated his probation and ordered that the restitution be taken from the posted bail.

ETA: After checking, he's done prison time for armed robbery and kidnapping.

Yeah I found out about his kidnapping time. Didn’t know about the armed robbery. Him and his brothers illegally towed a car, when the owner and father went to get the car, they locked them and beat them. Or something like that. Smh. What a great addition to the society.

And we wonder why they have no respect for the law.

Clearly we need more laws./S

I had something similar when I was younger and it went the same way. I can’t imagine how law enforcement keeps their morale up with the revolving door we seem to have for a justice system today.

This is ridiculous.....glad you at least got something out of this, albeit not much.

I had a cyclist who was texting on his phone plow into the back of my Jeep at a red light years ago. His handlebar went through my taillight. Just hopped on and took off all wobbly but at least his sore face/neck was some kind of justice in my case lol seeing his hand prints on the rear window made me chuckle even as I coughed up a few bucks for a new taillight.

Whether I'm driving my VW or my imaginary Porsche, I take pride in keeping it fresh. Not for everyone else, just for myself, and some criminal loon kicking/damaging it out of frustration at his pathetic life would be worse than him trying to land a right hook on me. Animals....
