PORTER, Texas — A homeowner fatally shot a suspected car burglar Thursday who he found sitting in his car, investigators said.

The Montgomery County Sheriff’s Office said the homeowner awoke to an alert from his motion activated cameras to activity on the driveway, KPRC reported.

“As the homeowner approached the vehicle and ordered the suspect out at gunpoint, the subject became aggressive and uncooperative and made the statement, ‘I will not go back to prison,’” Specialist Steve Squier told KTRK.

He was right.
He's not going back to prison.
 
I wonder if the homeowner tried to physically remove the suspect or if the suspect charged the homeowner?

Legal doesn't necessarily make it right.

I would much rather be able to send the guy back to prison rather than be able to say, "I killed someone for sitting in my car."

Good thing that the guy was a convicted felon. Otherwise, that story would have sounded awful to the officers on-scene when the homeowner told it. LOL.

IS he a convicted felon? So far (unless there is an update I haven't seen) we don't know who he is or what his status is.

Nah, thieves are scum. The guy gave the thief a chance but the thief apparently decided that he'd rather die than get arrested - well, that's his call.

The way I see it, I'd have to justify pulling the trigger on someone both legally and morally. Legally, I wouldn't have shot him if this happened in MA but in TX it's a good shoot. Morally, I have no problem with this guy putting down a thief. YMMV

This guy didn't have to kill him, he could have just shot him in his kneecaps. [mg]

I'm with you. If you are sitting in my car, I call the police. He could have had a gun as well, and not an immediate threat to me or my family. That being said, God Bless Texas

when my wifes dog, a 16yo ankle biter passes on, We plan to get another GSD. Almost as good as a rattlesnake :)
