    PD needs to do a far better job with psych screening and stress testing officers during training. Bet dollars to donuts the department has lower standards across the board for female officer candidates.

    “She crossed over a certain line,” Jackson Chief of Police Todd Smith said at the time, explaining that officers don’t have authority to arrest outside their sworn jurisdiction.

    An investigation pointed to charging Schultz with felonious restraint and aggravated assault, but Fremont County Attorney Patrick LeBrun, who was assigned as a special prosecutor, decided not to file criminal charges against the vacationing officer “because it is apparent she lacked criminal intent or evil mind.

    I also question that there wasn’t any mens rea here. If she indeed told police there was an armed robbery, when there was clearly neither a robbery nor an armed individual, if she threatened to shoot him having done no investigating or seen anything besides someone running, and refused to listen to anyone, that’s wholly unreasonable. Pulling a gun and threatening to kill someone without reason absolutely qualifies as knowingly criminal conduct. But as usual, police use the reason that they are police as reason to justify exactly this sort of conduct. It’s utterly perverse.

    She wasn't police in that moment though. On vacation and out of jurisdiction. Should be treated as one civilian threatening another with a gun with no cause.

    She was out of her jurisdiction, she had no police powers, if they won't charge her criminally they should go after her civilly, and attach everything she owns and her Police salary for as long as the judgement is valid ( 20 years?)

    Correct. Should. But the reality is, she wasn’t treated like anyone else. She was treated like a cop. Badges do give one extra rights. That’s how it is. And it’s perverse.

    She also threatened to shoot the victim. Serious business. If he'd kept running would she have shot him and also been exonerated because she "lacked criminal intent or evil mind?”

    ...and this was a Colorado cop in Wyoming. Didn't she have better stuff to do on vacation?

    It’s actually one of the requirements of many crimes. It’s called mens rea. Unfortunately it’s entirely ignored when it involves us mere peons, and used and abused when it’s not. Which is why cops and political elites avoid charges, but someone else, it’s “being tough on crime”, “making an example”, etc.

    She was out of her jurisdiction/ State and it is already been established she was acting without police powers, so Qualified Immunity goes out the window as she was acting without the permission of any police agency/ government.

    And as a civil case it is not "beyond reasonable doubt" but on the preponderance of the evidence... or why OJ was not guilty criminally but held responsible civilly.

    Where he would have her by the short and curly hairs is if he can argue successfully that she took his race into consideration.

    Did she see a youth or a Hispanic youth? Did she act on race in any part of her decision to detain him at gunpoint.

    This guy (also from Colorado) is now a FORMER police officer and in deep doggy doo doo for doing something similar, there is not going to be any qualified immunity here IMHO

    St. Louis did that with Somali immigrants. Now a woman is dead. The Somali failed numerous psych evals. Had numerous recommendations that he be removed from any duty that allowed him to carry a gun or outright dismissed from the police force. These recommendations go back to his days in the academy.
    But liberals still insist that lower affirmative action standards don't kill anyone.
