Now let's see if the AFT needs to take a step back.

About time the 4th branch of govt gets their peepee smacked.

But it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme in Section 111(d). A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body.

This country needs to get back to the legislative branch (congress) making laws, NOT three letter bureaucracies.

Congress is completely derelict in their constitutional duties by abrogating their responsibilities to made up agencies.

A positive ruling but I wish they’d put the chevron doctrine in the wood chipper and put an end to the agency ruling making power. Chevron like roe was a bad decision then and should be reversed.
