Last week, President Obama issued an executive order raising theminimum wage for federal contractors to $10.10 an hour. But theSupreme Court said that executive order is unconstitutional, theNational Review reported Monday.

Additionally, the court said, “when the president takes measures incompatible with the expressed or implied will of Congress, his power is at its lowest ebb, for then he can rely only upon his own constitutional powers minus any constitutional powers of Congress over the matter.”
 
Based upon Obama's immigration policy and health care reform its clear he is not concerned with what is and is not constitutional. He will move ahead with his agenda and worry about the supreme court later.
 
Read the article at. National Review. The court has not ruled on the minimum wage EO. The Examiner post title is misleading at best.

Yup. The National Review article cites the Youngstown Sheet and Tube Co. v. Sawyer case and uses the decision from that case to form its own (not the courts) judgement about this particular executive order.
 
The creap of Executive Orders in this country since the 80's is appalling. The fact that Conservatives have been fine with it as long as "their" man was the one doing it is why we are in this mess. That being said the tug between Congressional and Executive Power is not new, and likely will continue. The article is misleading, and a case would have to proceed to SCOTUS in order for the President's exercise of Executive Authority to be deemed unconstitutional. There is not authority for SCOTUS to issue advisory opinions.
 
Frankly I am all for increasing the minimum wage.

I do NOT agree with the executive order route though, regardless of which party holds the office. Executive orders may have legitimate uses, but raising the minimum wage is not one of them. This is more an issue of end running a congress that is sitting on it's hands and refusing to discuss the issue. Just saying 'NO' is not a discussion.

Haha everything you buy is made in China for fifty cents this will be the reason for companies to add another 500% to their bottom line. Don't fool yourself.

No, not everything but most consumers look at the price tag before the "Made in" label. People need to learn to buy for value. Have to love the critics though in their minds no one on minimum wage is worth it but they themselves are worth every penny. Gotta love it!

So tell me why?? Because minimum wage is too high? Are you paid too much? I might think so, can I ship your job overseas ... maybe, if not now possibly in the near future.

True, but I assume most US manufacturing jobs already pay more than $10.10 an hour, it's really the unskilled and uneducated entry-level labor force that this whole thing mainly applies to. You can't really outsource janitorial work or entry-level food services jobs to China, so that's where we'll see the cost of doing business rise and that will of course be passed onto the consumer.

Won't be long Chinese construction firms are now the larger construction companies in the world where we were once. They are now bidding and winning projects here in the US using Chinese nationals to perform the work and not with our wage standards. If you think it can't happen it will, the biggest threat is denial.

For all the office workers surfing the web, tweeting, texting, on company time you are noticed and your job can be outsourced.

Sure, but that has less to do with the minimum wage discussion and more to do with the fact that we give work visas to foreign nationals who come here and undercut native workers. Totally different issue.
 
Everyone should be able to support their 4-child family by working at mcdonalds, obviously. Its only fair.

You can... if you are the guy who runs the machines that will ultimately replace all the Fryolator-operators and burger-flippers if this horseshit continues.

Not really, when the minimum wage becomes too much of a factor for those to bare, as some believe in this thread, there will be a change. Resorting to undercutting the minimum wage with foreign workers legally, as is being done now with construction, it will have an effect on all.

I believe Henry Ford's idea on economics is much better.

The company I worked for (non-union) couldn't even build or renovate a private residence in Boston without being picketed. I'd like to see any of them get through a thorough OSHA inspection intact

Minimum wage is not a characteristic of a free market. Regardless, it is here, and is ONLY meant to be a starting point, and not a career wage.

If you find yourself demanding a higher minimum wage surrender your guns and join the progressive socialist movement.

Why - you like making everything in the economy cost more? You like inflation? People like you confuse me. Raising the minimum wage is inflationary. That devaluation in the dollar hits those who are on low or fixed incomes the hardest. In short - raising the minimum wage hurts the people you're trying to help the most.

I mean think about it. If McDonalds has to pay some kid more to make a hamburger and WallyWorld has to pay some kid more to stock shelves - what do you think that does to the price of that hamburger or the goods on WallyWorld's shelves... You folks just don't get it.

You think the end result is that hamburger and those goods on the shelves are more affordable for anyone - including those making minimum wage?
