Some Interesting FA10 Information

I recently saw on the GOAL website that they are discouraging anyone from using the new E-FA10 web page due to too many unanswered questions regarding registration.
And they went on to say that the folks in BOSTON are only accepting the "OFFICIAL" serial numbered paper forms that you can get at your local P.D., not the PDF forms that we can print out ourselves.
Well I stopped by Taunton P.D. to see if I could pick up a few and they informed me that the good folks in BOSTON contacted them and instructed them to "shred all of their documents" and that they would only allow the use of the E-FA10 web form. So I tried calling Raynham P.D. which is next town over to see if I could pick up some from them. Well they were very surprised when I told them about Taunton, stating thayt they had the forms, but get this, they could not give me any, as I was not a resident of their town ???? What happend to "TO PROTECT and TO SERVE"........

If its possible that anyone has about 8 forms to spare, I'd be willing to pay a reasonable let's say "fee" for them. I'm planning to do four transfers by years end, and four after the first of the new year..........

Can't help on the FA10s.
I think you will find the limitation of 4 private transfers is within any 12 month period, not in a calendar year.

Incorrect. It is a calendar year.

M.G.L. c. 140, §128A
Section 128A. The provisions of section one hundred and twenty-eight shall not apply to any person who, without being licensed as provided in section one hundred and twenty-two, sells or transfers a firearm, rifle or shotgun to a person licensed under said section one hundred and twenty-two, or to a federally licensed firearms dealer or to a federal, state or local historical society, museum or institutional collection open to the public. The provisions of section one hundred and twenty-eight shall not apply to any resident of the commonwealth who, without being licensed as provided in section one hundred and twenty-two, sells or transfers to other than a federally licensed firearms dealer or organization named above not more than four firearms, including rifles and shotguns in any one calendar year

Not according to GOAL. The only ones that CHSP will be accepting are the official "serial numbered ones" that you get at your PD...

interesting... well I sent them a few months back and since they haven't come back to me, I assume they were accepted. As far as I am concerned, I fulfilled my obligation.

Thanks for bringing this to our attention,

If you or anyone else can get anything in writing via snail mail, document, or email from any of the towns/agencies that are not cooperating in distributing the 3 part paper FA-10 forms it would be greatly appreciated. Please email it to me at the address below.

I have driven to a bunch of dirreent police stations between my house in worcester and where I work in westboro, and I get the same response from all: "we dont have the 3 part carbon forms. juts print it out or use the e-fa10." Some of the police stations that did have them though, were just the printable ones that I can do myself. [thinking]

Only ones that have the 3 page serial numbered forms, is GOAL.
 
general experience as of recent with FA10s
Several towns had a resident only for 3part forms
many towns where out and just gave me the website adress for eFA10
Most recently, was handed a photo copy of the pdf file and was told to make as many copies as I needed?
I have sold 3 guns in just the last few weeks, heard nothing yet from CHSB on the PDF version I sent in? Maybe by the time they get around to scanning it sometime in the future we will find out. Until then No online thingy for me, take my pdf version. I have my own records

Remember, every time you use the new electronic system, you justify their actions.

I've called them twice now. Each time they hit me with a barrage of questions as to why I am not using the online system. Then they begrudgingly tell me they will mail some forms to me and my local PD. I never receive anything in the mail and the PD still has no forms.

They are stonewalling. Phone calls to the FRB are useless in my experience. It is abundantly clear that no state agency wants us to use the paper forms and they are doing a damn good job of making it impossible to do so.

I just called them and asked for a bunch. We'll see if they show up. The guy on the phone (he seemed very reasonable) asked where I lived so they could send a bunch to the police department, too. According to him, when someone calls and asks for forms, they send a bunch to the PD at the same time to make sure they've got some. That seems pretty reasonable to me. (assuming you think *any* of the FA10 transaction registration system is reasonable)

He asked if I'd tried the online system. I started in on how it's insecure, how it's impossible to print a receipt in a gun shop without a laptop w/ cellular access and a portable printer, etc, and he interrupted me to say, "Ok, I understand some people don't like the online system, I'll send those right out to you."
 
Spencer PD was told the forms are online and I was told they will not provide the forms. I tried to explain that the online form was not working at that time and got no where. Basicly it is not their problem.

I picked up a few extra from the Southbridge PD who still carry the form used two have two for the next trade.
 
So what happens if we print out the pdf, fill it out and mail it in? Will somebody actually track you down and tell you that it's no good?
 
I know that GOAL doesn't recommend using the eFA10s, but does anyone have the exact reason why? I realize that given the fact that this is MA, and that the whole database might be on some HP from the mid 90s, but does anyone have any examples of an accidental release of owner's info?

My girl and I used it for her first gun, it was a PITA, and at the end when we wanted to print it asked for a password? It did not print and we could not go back. We had no record of the transfer. She had to call and have them mail her the copy.

I will never use it again.
 
Just seems incredibly inconvenient for FTF transactions, which is exactly why they are doing this. It will likely make more criminals out of otherwise law abiding citizens! I also believe they want the online database, to make tracking easier for them, as it will eliminate a person having to enter all transfer forms into their database manually, so that information that could get lost, or stored in boxes somewhere will not be at their fingertips instantly. Just another typical "big brother" maneuver!

They said they would return any forms that dont have the official serial number....

And that worries you why?

Do you really think they will send a SWAT team to your house, arrest and prosecute you for Mailing in the PDF form to them instead of doing it online??

Really?? Folks here are too worried about trivia.

If they return one to YOU, then "worry" about it . . . your choices at that time will be:

- Send in genuine serialized copy (assuming they send a blank one with every rejected PDF form [laugh]),
- File it away as your proof that they received your original submittal and that you did what the law required,
- Go online and do it there way,
- Contact your State Rep/Senator (suggest both) and complain that they are mandating something that is unworkable (if you aren't in a WiFi area you can't do online), not supplying forms to PDs, you can't print out your form unless home with your own network, security concerns wrt their system. [A couple of "inquiries" from concerned legislators will go a long way to sorting this out, as it did the last time they tried to stop all private FTF deals!]

Until they actually follow thru on their threat I wouldn't fret about it and just do it the way we have for the past year or two. IANAL and this isn't legal advice!

Yes, the online system cuts back their need for manpower, probably results in a more accurate database, etc. AT the expense of the user who can't do it where WiFi is non existent, if the parties want a copy they need to carry a printer with them as you can't go back and print prior entries (Jason Guida explained to me that allowing this would be a security risk so the system was setup that way intentionally). A portable printer is a MUST if you want a signed copy for your files!!
