2. Following in the abusive footsteps of these repressive regimes, the New Jersey
Attorney General has taken a series of actions to suppress Smith & Wesson’s speech, and with the
intention of damaging Smith & Wesson both financially and reputationally. The most recent such
action is the issuance of an administrative subpoena (the “Subpoena”) on October 13, 2020 that
allegedly seeks evidence of consumer fraud relating to advertising – but in reality, it seeks to
suppress and punish lawful speech regarding gun ownership in order to advance an anti-Second
Amendment agenda that the Attorney General publicly committed to pursue.

3. The Subpoena presents no legitimate inquiry into any purported fraud, and instead
targets mere opinions and other protected statements allegedly made by Smith & Wesson, such as
(1) whether Smith & Wesson’s products are “safe,” make a home safer, or enhance one’s lifestyle;
(2) whether an untrained consumer could successfully and effectively use a Smith & Wesson
firearm for personal or home defense; and (3) whether private citizens should have the right to
carry a concealed firearm. The only fraud here is the Attorney General’s abuse of his position to
suppress a political viewpoint with which he disagrees.

4. As the Supreme Court has recognized, “the enshrinement of constitutional rights
takes certain policy choices off the table.”2
Here, what must be off the table is the Attorney
General’s repeated abuse of power that violates the First, Second, Fourth, Fifth, and Fourteenth
Amendments to the U.S. Constitution, as well as the Protection of Lawful Commerce in Arms Act,
15 U.S.C. §§ 7901 et seq. (the “PLCAA”).
Within, some case history related to the PLCAA is mentioned.

Might be a federal court, but it's going to be heard by super liberal judges out here somewhere. I don't think any federal court has bitchslapped AG fishing expeditions, even Maura's fishing trip against glock wasn't slapped down.

and pray that they award S&W the entire state of NJ.

I think such lawsuits fall under "right to work" for lawyers - what judges will deny frivolous lawsuits when there's too many lawyers and not enough paying clients?
 
S&W living and doing business in gun haters MA complaining about how NJ treats them is like a battered wife complaining the guy down the street called her a name after getting punched in the face repeatedly by her husband.

If S&W cared about guns or how others were treated, they wouldn't be a business in MA

Decades ago when S&W has barely staying out of bankruptcy a owner of a large NJ sporting goods store with a very large gun businesses was seriously negotiating to buy them. In the end he passed on the deal.

Around the same time a NJ owner of a few gun shops bought Kimber. To this day Leslie Edelman still is the owner of the company and most of Kimber's products were manufacturered in NJ. Only recently did they move out of state.

It's not that easy to pack up a large company and move them a great distance. Finding new employees and training them or paying to move the key current ones. The down time to move the equipment... Serious challenges.

Sig avoided it buy staying local and putting a large amount of new machinery in the new location. That wasn't as big a deal as the old locations were still remaining functioning.

This brings back my youth... I loved going to Leslie Edelman’s in Montgomeryville PA... back then it was gun Mecca... I bought my 1st few guns from them.
