    Incorrect.

The 98.5 talking heads said the cops got a 'sneak and peak' warrant because 'human trafficking'. They called in a bomb scare to the plaza and installed the cameras without the owner's knowledge or consent.

Affidavit tells how video placed Kraft in sex spa

I think the cops should be prosecuted for making a terroristic threat (the scare), but that's just me. A gas leak report could have worked just as easily.

As expected, the judge in the case suppressed the video today. Cops didn't follow procedures. Also suppressed was evidence gained in the pretext stop of the car he was in. The PC developed from the video was improper, so the stop was improper. Not to mention that it was a pretext stop.

Why do I get the feeling the cops were put up to this or instructed how to by an political opposition research company like Fusion GPS?

    Fruit from a poisoned tree...

the whole reason for the warrant was fabricated. That means anything resulting from the placement of the cameras is ill gotten gains.

But you won't see any law enforcement officer, DA or other official charged for filing a false report.

I do not consider prostitution a victimless crime, and Kraft is presumed innocent until proven guilty in a court of law.

But unless they grant the employees immunity for their testimony, wiping out their ability to invoke the 5th they got nothing to go forward with.

Let's face it. He got a handy, and paid for it.

Let's face another fact, the warrant was wrong, the stop of the car was wrong, the execution of the surveillance by the cops was wrong, so the prosecution was wrong.

    Ergo, Kraft should walk.

We should be celebrating the fact that some judges have an understanding of the 4th Amendment and no one pulled an 'exigency' bullshit exclusion.

    Agreed.
On a side note... When I listen to Mike Felger talk about this on 98.5 (his show sucks), I'm a c hair away from calling him out on his bootlicking knob gobbling love of everything the government did in this case. I'd be interested in seeing him rationalize a cop calling him telling him the cops sucked here and he is an Uncle Sam.

Edit: I still ROFL when I see the picture of Felger on the cape at a restaurant covering his little toesies with napkins because it was chilly. That's all I needed to know about him.

Another way of looking at this is that Kraft was the only one who had the resources to stand up for the Constitution. It's looking like the State will have to drop all the cases, not just his. The cops could roll over a mere citizen but not the law.

Yah I was listening to that whiny Felger say Kraft has now made it difficult to prosecute future cases like this.
I’m finding it difficult to listen to this guy. They need to replace him with somebody like Ted Johnson.

It doesn't make it any harder. The po-po need to adhere to the limits stipulated in the warrant, and the cases can be prosecuted exactly the way they were before they tried to entrap Kraft. The only precedent here is the UNprecedented oversteps the police did:

    To Wit:
    1) a terroristic threat (bomb scare) to plant the cameras
    2) a traffic stop with no PC, and getting Kraft's ID

Bye Felicia. To quote the Patriot Way....do your job next time

Meh. I just think the Kopsch who came up with this stuff had delusions of grandeur based off some tip from a CI, and they were huffing too many glue fumes from the jar of rubber cement given to them by the CI.... "Deer Fever" type stuff happens with police, too. Especially WRT human trafficking because that's a huge
    buzzword down south, too.

If it really was a conspiracy, what's the political memetic value here? Cuz Kraft is friends with trump? That's pretty weak, by itself.

Felger is a clueless retard, and what Kraft did changes absolutely nothing. Someone might want to tell Felger what "fruit of the poisonous tree" is, a doctrine with regards to evidence and due process of law that has been around forever. Just because Kraft is one of a limited number of people with sack and money in this country to challenge a criminal charge based on illegally obtained evidence, does not magically invalidate the idea that you cannot prosecute someone with illegally obtained evidence. If the police do their jobs correctly, then voila, magically their evidence gathered by lawful processes is not invalid. If they don't like the fact that an accused person called them out on their bullshit they should give up police work and turn in their badge, and leave it to people who can be "bothered" to build cases the correct way.

I honestly wish it wasn't so painful or difficult for people to utilize these protections, frankly I would love to see more cases that just got discarded because the
police either f***ed up the evidence, or there was a 4A violation, etc, that lead to the charge, and so forth. The sad thing here is if it was anyone other than Kraft a bunch of people would be getting prosecuted with illegally obtained evidence, and the system would have likely gotten away with it unless a public defender got very ambitious/suspicious about the whole thing....

Pocket change for him, a lot for most of us. I expect that the other defendants that haven't yet plead guilty we jump on this decision. In fact, some of the defendants who did plead out might try to withdraw their pleas.

I think that the cops and the DA fell for the "Human Trafficking" BS because it's much sexier to make that sort of arrest than just a hooker/John sting. So, the probably "embellished" the story a bit to get the warrant. Which wasn't actually the grounds the judge used to strike down the evidence.

I don't even know what a Felger is.
