Quick hunting question:

I believe Mass was incorporated as a state long before all the horse and buggy driving freaks in Ohio...

The game belongs to the state in every state of the union.

The idea that it is OK to trespass on someone's land without asking is just too f-ed up for words.

I fail to see how this is socialism. People are free to post their land, the state will even give you signs to do it. Just because something is a benifit to people does not automatically make it socialistic. If I own land and dont care one way or the other if someone comes along and hunts I am far from a socialist, Im a good neighbor. What your talking about is being an isolationist.

You KNOW the land you are about to enter does not belong to you. Why do you need to be told that you cannot enter?
Because thats the way its been since the Pilgrims Landed, Its not up to me to change nearly 400 years of tradition.....If I dont want people on my land I post it "No Tresspassing". Thats why they make "No Tresspassing" signs and not "Hey, Come on In" signs

what if you dont know the land belongs to someone?

what if you are walking in the woods, and someone just happens to own 30-40 acres in the middle of the woods, they bought for cheap to use as hunting ground, but they aer not posted, how the hell are you supposed to know? places like Maine sell land in the middle of mountains all the time, usually less than $1000/acre

what if you shoot a nice deer, the deer runs a 100 yards, and happens to die on private property? you could get arrested for retrieving a deer from private property, because you can not prove you werent hunting in the property. this way, if its not posted, you just dont know. and you are fine. If it is posted, then take your chances and get the deer out of there ASAP.

all the owner has to do is get a few signs and staple them to a tree, not a lot of work.

That is a really ignorant and arrogant comment. But coming from you it is hardly surprizing. Just because the law is different here does not mean we dont know what private propertly means in other states and wont follow the laws there. When in Rome do as the Romans do. If I hunted in Ohio I would get permission on private land or hunt public lands. In Mass I am not required to have permission in most towns and on the few properties I do hunt that dont require permission I those properties and their owners with respect so that they do not feel compelled to post it.


Things are different here and apparently you are the one who can not come to grips with it. Every state in the union has the right to regulate their own laws pertaining to property rights. If you dont like it then stay the F out of the state!
 
The attitude being expressed by some regarding private property amazes me.

I've got a fool in my neighborhood who routinely walk(ed) his dog through my side and back yards (residential street) and when confronted, acted offended that I didn't want him treating my property as his own.

I was stunned by his attitude and that of some of you here. Private property is private! The effed up law here may require that I post my yard as 'no trespassing' before the freakin cops will do anything, but that turned out to be unnecessary.

I was able to finally convey my displeasure to this boob in a manner that caused him to conclude that unpleasant consequences could ensue.

So, to be able to shoot, you either need to: 1-find the owner and ask for permission, and 2-if the land is not privately owned, ask the town for permission.

So, who cares if the state requires you to have permission or not, most towns do. I didnt check the by-laws for every town, but im pretty sure that about 90-95% of towns in Mass have a bylaw prohibiting shooting, unless you have permission from the owner or the town.

Yes, in the rest of the country you had damned well better be sure you know where you are. You are not free to wander blissfully without knowing where you are. Lack of fences or signs are no excuse.

Incorrect. The majority of the towns do not have discharge or hunting restriction bylaws. Maybe inside the 495 perimeter that is the case but outside of that it is not the norm.

What you did not notice is that site is only a listing of towns that do have restrictions. If a town does not have discharge or hunting bylaws it is not listed on that site.

There are only 77 towns listed on the site. If you subtract that from the total number of towns in Mass which is 351, you get a substantial number of towns (274) that do not have restrictions even if there a few missing from that site which there probably are.

Which number is bigger, 77 (with bylaws) or 274 (without bylaws)? [smile]

I'm assuming that your assumptions about town by-laws are correct in your area, but I am about 90-95% sure that the further west you travel in the PRofMA, the quicker the number of towns banning firearms discharge will approach zero.

Never reach it, mind you - still a few pockets of liberalism out here. Still, it's better than you think.
