question for my brother , for the people who know about applying for a license

So my brother was filing out the paperwork for his license.

He came to me and told me when he was young and in florida he got caught with a joint in his car , and did a plea deal for a misdemenor intervention program in which he just sent them urine samples for the summer.

I assume that he is convicted of illegal drugpossession, so i told him to say yes on the form.

What are his chances of getting a license and is he a PP in MA?

It depends on the EXACT charge and, likely, disposition, as to whether he's SOL from the get-go.

Assuming that he's NOT SOL, it comes to discretion on the part of the licensing authority.

He should contact the court where it was adjudicated, and get a copy of all relevant paperwork. He should then get a copy of the then-applicable penalties, etc. to see where he stands. If it was a state charge, then the meanings of the words may vary from what they mean in the PRM. It's the old, "It depends on what the meaning of 'is' is," thing.

I'd advise him to do this BEFORE submitting the application. If there's a potential issue, have him contact a specialist lawyer.

I was actually in a similar situation in FL as a minor. I was sure it wasn't a conviction but in FL a single minor misdemeanor arrest ( non conviction) automatically gets expunged around age 24 (if you stayed out of trouble. Contacted the courts and any other agencies in FL to get my info. Could not obtain any info on it at all. I know I took some sort of intervention program (reg drug tests a class on the dangers of drugs etc etc. ) similar to a cwof in mass. Since I was sure it was NOT a conviction. I put the date of arrest on my app, listed that I completed a intervention program, and wrote non conviction. I did not have any issues getting my license. I also live in a very green town

He needs to be honest about it. Does he know exactly what the charge was, date of arrest and if he was convicted or not? He can contact the local county court down there and request his records. (If they still exist) they did not have any record of mine

I was actually just about to turn mine in when I decided to wait and try and get paperwork from fl. It took a few weeks (you can pick it up in person or send a notorized letter requesting it) but they did not have any record of it. They had then told me about the automatic expungment process. I figured it could be in some database somewhere so chose to be honest about it on my app. If i did not live in a very green town I would of most likely hired an attorney to help me complete my app
