If on the jury I'd give the shooter a pass on this one. That said, what a bunch of complete pussies. Side step the attacker and let him plant his own face on concrete, then pin him down and/or incapacitate him from doing anything else. A dipshit like that is easy-peasy to handle. Over the last 8 years I have seen a dramatic increase in many on the LEFT believing their beliefs and rights extend to being allowed to assault others they disagree with.

I'm sure the victim has a throng of civil rights lawyers at his doorstep. According to the law, it's a clear-cut case of self-defense. His counsel will take this to higher courts if Newton continues to press this issue.
 
One thing to note, the guy didn't shoot until he was on the ground on his back. At that point there is no retreat and you have someone on top of you intent on harming you. I don't see any way this wins at trial other than the fact it's MA so it's about the same as a Trump trial in NYC, there is no jury of your peers there.

The society got hijacked same way like it was back in 1937 Germany. It is blatantly obvious and nothing can be done now, legally against those DAs who will continue to transform the rules of the game.
