The written law, states a pistol cannot exceed a manufactured weight of 50 ounces, does anyone know if this applies to Encore or Contender pistols that are obviously single shot? In a lot of cases people build them up as opposed to buying them pre assembled. I'm not sure how much they weight either, but some of those big bore rifle barrels are pretty heavy.

Thanks

I'm assuming the "Pub.L. 103-322, § 110105(2), effective Sept. 13, 2004, repealed par. (30), which read: “The term‘semiautomatic assault weapon’" at the top means they're not affected, but you never know in MA!

not quite sure where you're trying to go with this. do you think a break open gun is some how going to appear on a semi auto ban of some type?

Regardless of features which it is equipped with, a pistol which is not semiautomatic (or which is semiautomatic but not equipped with a detachable magazine) CAN NOT be an assault weapon by the feature count test based on (the former) 18 U.S.C. § 921(a) (30) which is referenced in MGL c. 140 s. 121.

The weight feature that the OP is referring to only applies to certain semi-automatic pistols.

Specifically, a pistol which is not banned by name (or as a copy or duplicate of a named fiream is only banned if...

(1) It is semi-automatic

AND

(2) It is a fed by a detachable magazine

AND

(3) At least 2 of the following features

  1. an ammunition magazine that attaches to the pistol outside of the pistol grip;
  2. a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
  3. a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned;
  4. a manufactured weight of 50 ounces or more when the pistol is unloaded; and
  5. a semiautomatic version of an automatic firearm; and

That law you've quoted doesn't apply to either of the pistols you've listed.

The law applies to "assault weapons", which have to be semi-auto as part of the definition.

Mmm let me pin the mp40 9mm mag in the new gsg 9mm pistol and poof , its legal lol.. i wish.

Why wouldn't it be legal. That's a perfectly reasonable solution if you can figure out how to load the mag and if you are willing to live with a non-removable mag.

The AWB as it reads for pistols, only applies to semi-auto pistols with detachable magazines. Remove one of those two items and nothing else matters.
