Offending someone is against the law?

Depends. Disorderly conduct is recognized by all 50 states I believe. With penalties and definitions Varying from state to state. Using vulgar language in a public place, conduct causing a crowd to gather in the public thorough way and so on. Cop may be standing on solid legal ground to write a citation here.
 
The cop is issuing a citation, argue the law with the judge. I'm betting it gets thrown out.

Disorderly Conduct is pretty much the "I'm annoyed at you, but I don't think I can get away with charging you with anything else" charge.... Does it have a purpose? Sure... but it's heavily abused.
