Odd "BANNED" mag question

So i recently purchased a glock 27 in MA from a MA resident. It came with a magazine,9 rounder stamped "leo/govt only 9.13.94"
My question is, is this a banned mag ?!? its only 9 rounds. Im pretty sure because its stamped, its banned no matter what..... but i want to be sure before i toss it in the trash.

There's nothing that I've seen in the law that would make a marked magazine illegal, but I've never seen a marked magazine that was not "high capacity." Are you sure it's not one of the 11 rounders that has been modified somehow?
 
“Large capacity feeding device”, (i) a fixed or detachable magazine, box, drum, feed strip or similar device capable of accepting, or that can be readily converted to accept, more than ten rounds of ammunition or more than five shotgun shells; or (ii) a large capacity ammunition feeding device as defined in the federal Public Safety and Recreational Firearms Use Protection Act, 18 U.S.C. section 921(a)(31) as appearing in such section on September 13, 1994. The term “large capacity feeding device” shall not include an attached tubular device designed to accept, and capable of operating only with,.22 caliber ammunition."

You should be good.
 
That means that during the Fed Ban it was originally made/sold with a x round extension on it (probably 2 rds making it an 11 rd mag) and LE/Mil legal only.

Without that extension the mag is perfectly legal for a mere MA subject to own. HOWEVER, many LEOs will not know/understand the finer points of that law and may hassle you about it.

The marking didn't Automatically MAKE possession illegal . . . it was a Fed required indicator so that one could look at something and know the status of the device. However, changing the item (putting a standard base on it) does in fact change the status of the device (making it a 9 rd and MA legal mag).

What to do with it will be a decision you have to make.
 
Yes, it came to me with a standard glock floorplate on it, keeping the capacity at 9. So it IS legal!! Good thing I asked!! thanks guys. I appreciate your help.

It has nothing to do with MA. The "LEO only" markings were a federal AWB thing.

Oh c'mon. This place just wouldn't be the same without all the sarcasm. :D

I would keep the mag, show it to all your friends and just tell them you "know people".
 
Interesting topic arises out of this. Since the AWB has sunsetted, is it now legal to in one way or another delete the date and or LEO ONLY markings from those magazines?

I'm not a lawyer, but I don't think that would be illegal assuming you're legally allowed to possess them in the first place. I can't imagine why someone would bother though.

It's a 9-round mag. Perfectly legal for even a Mass permit holder. I'd consider it to be a range mag, not a carry mag. Just because it's legal doesn't mean he won't get extra hassle from a cop who is throwing everything at him to see what sticks.
 
I've heard from a few lawyers that owning post ban high capacity magazines is a crime that has never been prosecuted in this state. I wonder if this is mostly because our gun laws are confusing to even law enforcement?
