1. Preemption. The State intends to occupy and preempt the entire field of legislation concerning the regulation of firearms, components, ammunition and supplies. Except as provided in subsection 3, any existing or future order, ordinance, rule or regulation in this field of any political subdivision of the State is void.

2. Regulation restricted. Except as provided in subsection 3, no political subdivision of the State, including, but not limited to, municipalities, counties, townships and village corporations, may adopt any order, ordinance, rule or regulation concerning the sale, purchase, purchase delay, transfer, ownership, use, possession, bearing, transportation, licensing, permitting, registration, taxation or any other matter pertaining to firearms, components, ammunition or supplies.

3. Exception. This section does not prohibit an order, ordinance, rule or regulation of any political subdivision which, with the exception of appropriate civil penalty provisions, conforms exactly with any applicable provision of state law or which regulates the discharge of firearms within a jurisdiction.

4. Law enforcement agency. Nothing in this section limits the power of any law enforcement agency to regulate the type and use of firearms issued or authorized by that agency for use by its employees. For the purposes of this section "law enforcement agency" has the same meaning as set forth in section 3701.

THE RULE BEING CHALLENGED

"The possession and/or use of firearms or weapons is prohibited in all areas between May 1 and September 30, except where hunting is allowed during this period. Firearms or weapons may be transported across the Restricted Zone of the Allagash Wilderness Waterway, between May 1 and September 30, provided they are securely and completely enclosed in a cover, fastened in a case, or dismantled in at least two pieces in such a manner that they cannot be fired unless the separate pieces are joined together."


This is a rule of the park and violation of the rule is a class E crime, which is the least serious crime class.

So you can't carry a gun in the woods in maine during the warm months?

That's frigging lame.

While we're at it, what exactly is a "class E crime"?

Paul….I spoke with Tom Morrison this morning and we are trying to work this out. I also talked to the AG who is looking into the legality of the regulation…..
 
I see the sign every time I go into Baxter. Here is the BSP rule.

22. FIREARMS, HUNTING, AND TRAPPING: Hunting and trapping are prohibited within the Park. Use or possession of any firearm, bow and arrow, sling shot, or air rifle or pistol is prohibited. Firearms may be transported through the Park if kept in a car trunk, enclosed in a case, or otherwise inaccessible to use. Bows may be transported through the Park if unstrung or enclosed in a case. This rule does not apply north of Trout Brook and Wadleigh Brook in T6 R9; in T6 R10; or in T2 R9 and in T2 R10 north of the West Branch of the Penobscot River, east to the thread of Abol Stream and west to the thread of the West Branch of the Penobscot River. Hunting with dogs is prohibited as defined in BSP Rule #4. General laws of the State pertaining to hunting and trapping apply in those areas, except that moose hunting and baiting any animals for hunting purposes are prohibited.
