Useful tip:

Do not use anything related to work as ALP justification unless you employer is prepare to confirm in writing that you are authorized to be armed on the job. I know of one case where a person who had a job with employment terms "instant termination for posession of a firearm" tried to get an LTC in a discretionary jurisdiction based on "on call to visit customer sites 24x7" - and the licensing authority said "fine, we'll issue as soon as you bring a leter from the employer stating you are allowed to be armed at work." End of story.

Then there is the one about the woman who applied for an LTC because she feared for her safety while taking night courses at a university in Boston. No, I am not making that one up.

BTW, Quincy PD's chief Crowley is very much into rewarding his friends and punishing only those he doesn't like. Check out any available articles (and letters to the Quincy Patriot Ledger) about his appointment of Lts. recently. Seems that Don Kusser (BOD of GOAL, VP of BR&P, and thorn in the chief's side about the LTC issue) has a Brother who is on Quincy PD. Said Brother was one of the top candidates for LT, and was summarily bypassed . . . allegations are that it is directly related to Crowley's hatred of Don Kusser (a City maintenance employee). I read a letter to the editor and article posted at BR&P but have no further info on the allegations. [This is not unusual in the world of politics and public jobs.]

When I say that this could happen to one of us... I don't really mean leaving it on the top of the car. But something close, maybe it falling out when getting into or out of the car. Or having it fall off your pants when using the bathroom.

Anything that would cause someone to leave it or lose it.
 
C-pher, my comment about leaving it on the roof was actually "in response" to QPD's comment and "special treatment" of the PO. Most of the POs that I know are NOT gun people, but I can't imagine them unholstering and putting the gun on the roof of their cruiser or POV!

Yes, many years ago when I was using generic $10 leather IWB holsters, I had two occasions where the gun when "thunk" on the floor of a bathroom in commercial buildings. You won't believe how fast I picked the gun up and re-holstered it! When it drops from ~6" off the deck it doesn't get far, but you can bet that I'd do a "duck squat walk" (NOT a pretty picture to contemplate) if necessary to retrieve it post-haste. I certainly would not "forget it" there!

And I never remove the gun from the holster when going to the bathroom. Can't imagine ever doing that intentionally!

So, how common is it to use these types of issues to our (the general public) advantage in court?

Is it anything like using a previous ruling? Where it's been done before, therefore it can be used as an argument for something that happens in the future.

Guns are not allowed on school (whether it be kindergarten or college) property....I believe it's 1000 ft. out.
 
Oops! got it.

I know Maine bans firearms at or near (500 feet) public schools, but I guess I never thought of a college campus, even a state school, as being either a "public school".
 
Absolutly! I'm a UMaine Orono Grad. All guns had to be surrendered to Public safty upon entering campus. And if you were caught with guns and/or ammo on your person it was grounds for your walking papers.

Never saw anything wrong with this (As countless rapes and such went on on campus on weekend....they gave the ladies whistles...)

But then again I was just another Penniless boy from Portland, from Liberal Parents.

I think your chances are not too good, considering that the general fact of living in Boston with it's rising crime rate doesn't seem to be considered sufficient need for an ALP license. I don't know what kind of schedule you are on, but you might find additional information to build your case in the crime statistics for your neighborhood.

In addition, you may also request a printout of all 911 calls for service to a particular street. There are also monthly crime statistics posted in our Statistics Section.

The only problem is the time involved; it might take a while for them to mail you the information. I don't remember how long it took for them to get back to me when I was looking for neighborhood information, but I think it took between 2 weeks and a month after I faxed my request.

Come to think of it, I did that a few years ago. Might be worth doing it again, just to see how the neighborhood's been changing...

MGL 269 chapter 10j makes it a crime to carry a handgun on your person in MA, even if you have a MA LTC, unless you are a LEO or have formal permission to be armed granted by the school.

The 1000ft out is from the Federal "gun free school zone" act. That federal law (rules unconstitutional by SCOTUS, so congress passed a not yet tested "we really mean it" clone of the law claiming it related to interstate commerce) specifically exempts carry if licensed to do so by the state. The MA law does not have a 1000ft buffer zone, and the LTC is good in that surrounding area, so the federal law does not come into play if you are off school property but within the 1000 ft donut ring.

I'm glad I came to my senses too!

Hell in "Hearts in Atlantis" Stephen King called Orono in the 60s (And maybe damn near any other College or the like) to the City of Atlantis.

I wouldn't know much about the 60's, bein only in my late 20's.....but I would definetly agree that college campuses have become Isands upon themselves.

Reality doesn't apply....and if you don't belive me, just walk through Harvard Square any time on any day. 8)

To get back to his original question before going completely off topic (again or yet??), I, like the others, don't think your chances are all that great for upgrading. We're talking Boston here. I've heard too many stories of it's "who you know" and if you don't know anyone, then tough cookies. You can try it hun, but right now, there are parts of this state when you can wish in one hand and crap in the other...which one will fill up first? I think you catch my drift.

I used to be a lib, and I mean a lib. I was a member of PETA, the Clam Shell Alliance, Amensty In'tl, and a few other smaller org's. I also voted for Carter, but I saw the light and came to and I thank the Universe that I did. I have done a 180 on my stance on everything...including guns. Yes, I used to ask, "But what do you need an AK or an Uzzi for?" My parents were conservative, and I chalk it up to asserting my immature independence before I got smart enough to realize the blather I was spouting. My dad was greatly relieved as well. :D
