Under 'emergency order' about coronavirus, 'that's exactly what they're doing'
Two New Jersey officials have been sued for their actions that essentially suspend the Second Amendment for American citizens in their state.

The case was filed by the Second Amendment Foundation and the New Jersey Second Amendment Society on behalf of Robert Kashinsky and Legend Firearms, a gun shop in the state.

Defendants are Gov. Philip D. Murphy and State Police Supt. Patrick J. Callahan.

"Gov. Murphy cannot simply suspend the Second Amendment, and neither can Supt. Callahan," said SAF founder Alan M. Gottlieb. "Yet, under this emergency order, that's exactly what they're doing. The Constitution, and federal law, don't allow that. New Jersey may have been the first state to ratify the Bill of Rights, but they're the last state to recognize it."

I grew up there. Never looked back since I left. MA gets a bad wrap but I Lear’s we can keep things without fear of prosecution.

I used to live in that shithole also. Every time you want to buy a gun, you have to go to your local PD and pay $3 to get a “permit to purchase” a firearm and wait a couple weeks for it to come back. That permit is good for one firearm.

the only reason jersey is still part of the united states is because it's situated on the coast line. if it were land locked and on a border with either mexico or canada, the government would have sold it long ago to one of them.

Ma guns stores are not on the essential list...Are we going to sue?

That is what the article is about.

"Suspending the 2nd Amendment" sounds like they're banning people from owning guns, or something, but the focus of the lawsuit is really considering gun shops as non-essential and having them close and not issuing the purchase permit stuff. They're arguing they've "suspended the second" by not allowing people to buy guns. You could argue that, but it's a narrow part of what 2A means as a whole.

So while NJ sucks, it's another hyperbolic article with a somewhat deceptive clickbaity title.

Ehh, the second is pretty short and clear. Courts have upheld that a license does not interfere with your second amendment right as you can still externalize that right, you just need the license.

Now that the license is not available, second amendment rights have been suspended- not ours because we have our licenses, but the new guy who wants to protect his TP stash and cant get the license fundamentally now has no 2a right. NH, MA, etc. Should be on the hook for this- they essentially argued this was better and they can handle it, and now that they they hit a speedbump the answer shouldn't be "no rights for you!" they should be obligated to stand behind the system they argued for or get rid of it all together.

Unfortunately, the courts are closed, right?

This is why we have guns, because when shit goes South, and Emergencies are declared, Tyranny comes out of the woodwork, and there is a darn good chance it won't relent when the Emergency passes.

Guns, not the Constitution, are the only thing that will protect Individual Liberty when Society starts to fall apart.

If you read the article they shut off the check system as well.
It's a good deal more than closing brick and mortar stores.

I feel this should be framed in a way that non-gun owners/anti-gun crowd can understand. If you can take this away, then what's preventing GOV from removing freedom of speech, press, or religion under the guise of an emergency declaration? If they can do this, then the next step is incarceration with no due process (which ironically was being explored just a couple weeks ago). Hell, let's just bring back slavery because of COVID. Screw constitutional rights and the 13th Amendment.

The sheep that will go along with this and even support it only see it as a can grabbing measure. And while that's one immediate result, that's not the core issue. The core issue is removing inalienable rights secured by the constitution. There is no situation or emergency that should be able to suspend these rights.

That would be like refusing to accept LTC applications here in Mass.
Yup.
There are going to claim virus on that one.
Someone told me today that Lynn is still accepting though.
A would love to see the twist of logic trying to explain shutting off the FA10 system though.

Don't put it past Maura infecting the FA10 system with a special virus of her own.
It still runs on Microsoft Windows 95 which is no longer gets security updates.
You know a computer technician can pick up a virus from a mouse, right?

So in about 5 years this might get resolved

Actually, it's been resolved in less than a week:

The change came after the federal Department of Homeland Security, in an advisory Saturday night, listed gun dealers to be “critical infrastructure.“
At least three gun rights organizations have filed lawsuits in recent days to force the state of New Jersey to allow gun stores to open. Several Republican lawmakers called on the governor to allow it as well.
“In accordance with the guidance released over the weekend by the federal Department of Homeland Security , we will allow firearms sellers to operate,” Murphy said during his briefing.
