Derry board signs off on home gun business

DERRY — Despite the objections of many of their Hubbard Hill Road neighbors, Alan and Susan Fillingham were granted a special exception by the Zoning Board of Adjustments to operate an Internet-based gun business from their 18 Hubbard Hill Road home.

Although the ZBA typically grants the special exceptions for home-based computer businesses without much fuss, the nature of the gun business did create a close vote, with the special exception passing, 3-2.

The start-up business, Brothers in Arms, will focus mainly on the sale of antique and collectable firearms, and Fillingham said the great majority of sales will be done over the Internet. While he said the ATF requires him to keep business hours, Fillingham said those hours will be by appointment only and that he does not expect to have many customers coming to his home.

In addition to the firearms, Fillingham, a competitive shooter, said he will be selling ancillary supplies related to competitive shooting.

I don't know much about procedure or zoning ordinances, but it seems very dumb that people need to go through a 5 member super special committee to get approval to start a business.

it is zoning, the same thing that keeps the adult book store from being opened next door to your house.

Try opening a home based FFL in MA, you can't. The state says not without a physical storefront in a allowed use area. No "kitchen table" FFL's allowed.


NH is different when it comes to businesses being operated out of your house/residential property.
 
In NH, it really depends on what Town you live in. THe owner of Merrimack FireArms had a battle with Merrimack about a home based business that lasted a very long time, before he opened his retail store.
 
'Shall issue" for home business

Many NH towns distinguish "Home Occupations" (no customer traffic) with no zoning board review from low-traffic "Home Businesses", and common zoning wording is "home business shall be permitted". My town also explicitly permits small permanent signs in a residential area for a home business, without having to fight for a sign permit like some towns require.

Some restrictions on businesses in residential areas are unavoidable. At least NH keeps these restrictions to a minimum.
