  • Jonathan Murphy, 42, was shot and killed during jewelry store robbery inside Rolling Oaks Mall in San Antonio in January 2017
  • His widow, Aimee Murphy, is suing the mall and its parent company, claiming shopping center failed to display signs at all entrances barring guns
  • Lawsuit also alleges had there been signs, a Good Samaritan would not have brought his gun inside the mall and would not have tried to stop the heist
  • Surveillance video released by Aimee's lawyer shows two robbers running inside Kay Jewelers, one pointing a gun
  • Good Samaritan Ryan Brockett runs over with his gun drawn and opens fire on the thieves, who return fire
  • Police said Jonathan Murphy was struck by multiple rounds, allegedly fired by suspect Jason Prieto, and died in Aimee's arms
  • Prieto is still awaiting trial nearly four years later; accomplice Jose Luis Rojas pleaded guilty in 2018 and was sentenced to life in prison

Disturbing surveillance video has been released for the first time showing a smash-and-grab jewelry store robbery at a Texas mall in 2017 that resulted in the shooting death of a shopper.

The victim, retired US Marine Jonathan Murphy, died in the arms of his wife, Aimee, after shielding her from bullets during a gunfire exchange between the robbers and an armed Good Samaritan at the Rolling Oaks Mall in San Antonio in January 2017.

Jonathan and Aimee Murphy had gone to the Kay Jewelers store at the mall on the afternoon of January 22 to have their wedding rings cleaned.

 
Rest in Peace . Delicate subject here..I feel for him and everyone but with all due respect.. im conflicted on the lawsuit. I think he would have done exactly what I...and you have done 100 times. There have been a dozen threads on this subject.

Question is why did Jonathan and Aimee not turn tail and get the hell out of there as soon as hammer smashes glass? They are like loitering around unarmed while these guys are waving guns and smashing glass. Geez get the hell out of there!

In TX a business has to display a specified sign to prohibit guns on the premises. If they don’t, whatever policy they may have prohibiting guns is not enforceable against patrons.

Whether they displayed signs “properly” at “all entrances” appears to be a the point in question. I’ve seen the same myself at TX hotels with front door signage but no signs on alternate public entrances. Or they will use an unobtrusive mini-sign that doesn’t comply with state law on size and content.

The code in question:
"Written communication" means:
(A) a card or other document on which is written language identical to the following: "Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun"; or
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both English and Spanish;
(ii) appears in contrasting colors with block letters at least one inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to the public.

"According to the new lawsuit, the Good Samaritan did not know that he could not bring his gun inside the mall because he never saw signs barring customers from carrying firearms on the premises. 'There's no way for the person walking into the mall to know they have the no-gun policy unless they actually stumble upon one of these signs that they've testified to that they don't really prominently display,' Stanley Bernstein, Aimee Murphy's attorney, told News 4 SA."

If not a frivolous lawsuit, it’s a stupid one.
